ORDINANCE NO
AN ORDINANCE AUTHORIZING THE FILING OF AN APPLICATION WITH THE
DEPARTMENT OF TRANSPORTATION, UNITED STATES OF AMERICA, FOR A GRANT
UNDER THE URBAN MASS TRANSPORTATION ACT OF 1964, AS AMENDED, AND
PROVIDINGAN EFFECTIVE DATE
WHEREAS, the Secretary of Transportatmon is authorized to
award grants for a mass transportation program of pro3ects and
budget, and
WHEREAS, the contract for flnancmal assistance will mmpose
certain obligations upon the applicant, such as the Cmty of Denton,
mncludlng an oblmgatmon to provmde the local share of the pro3ect
costs in the program, and
WHEREAS, the U S Department of Transportatmon requires, mn
accordance with the provlsmons of Title VI of the Clvml Rights Act
of 1964, as amended, that the applicant gmve an assurance that mt
will comply with Title VI of the Clvml Rights Act of 1964 and the
Department of Transportation requirements thereunder, and
WHEREAS, it is the goal of the applmc~nt that minority
business enterprises be utmllzed to the fullest extent possible mn
connectmon wmth thme project, and that defmnmte procedures shall be
established and admmnlstered to ensure that mlnormty busmnesses
shall have maximum construction contracts, supplies, equipment
contracts, or consultant and other servmces, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ That the City Manager ms authorized to execute and
file an application on behalf of the Cmty of Denton, Texas, wmth
the U S Department of Transportation to aid mn the flnancmng of
planning, capital and operatmng assmstance projects pursuant to
Section 9 of the Urban Mass Transportatmon Act of 1964, as amended
ECT~_~II That the Cmty Manager ms authormzed to execute
and file with such applications an assurance or any other document
required by the U S Department of Transportatmon effectuating the
purpose of Title VI of the Clvml Rights Act of 1964
~II That the City Manager or hms desmgnee is
authorized to furnmsh such addltmonal mnformatmon as the U S
Department of Transportation may requmre mn connectmon wmth the
application for the program of projects and budget
~ IV That the City Manager as authorized to execute
grant agreements on behalf of the City of Denton, Texas wath the
U S Department of Transportation for aad an the fananc~ng of the
plannang, capital and operating assistance program of projects and
budget
~ That this ordanance shall become effectave
