AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE
FROM THE SINGLE FAMILY 7 (SF-7) ZONING DISTRICT CLASSIFICATION AND
USE DESIGNATION TO THE OFFICE CONDITIONED (O(c)) ZONING DISTRICT
CLASSIFICATION AND USE DESIGNATION FOR 1 211 ACRES OF LAND LOCATED
ON THE WEST SIDE OF HINKLE DRIVE, APPROXIMATELY 500 FEET SOUTH OF
HAGGARD LANE; PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF
$2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE
DATE
WHEREAS, Mr Don Richards, on behalf of Ms Rhonda Banks,
lnmtlated a change in zonmng for 1 211 acres of land from the
Slngle Family 7 (SF-7) zonmng dlstrmct classlfmcatlon and use
designation to the Offmce Condltmoned (O[c]) zonmng dmstrlct
classlflcatmon and use desmgnatzon, and
WHEREAS, on March 13, 1996, the Planning and Zoning Commmsslon
recommended approval of the requested change mn zonmng, and
WHEREAS, the Cmty Council finds that the change in zonmng
be mn complmance wmth the Denton Development Plan, NOW, THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
_~ That the zonmng d~strmct class~fmcatmon and use
desmgnatlon of the 1 211 acres of land descrmbed in Exhmb~t 1, ms
changed from the Single Family 7 (SF-7) zoning d~str~ct classifI-
cation and use designation to the Office Condmtmoned (O[c]) zonmng
dmstrict classlfmcatlon and use desmgnatmon under the comprehensmve
zoning ordinance of the City of Denton, Texas, sub3ect to the
followmng condmt~ons
I The shall use be for Offmces, Professional and Admmnms-
tratmve only
2 Maximum square footage of all bumld~ngs constructed on
the subject property shall not exceed 5,000 square feet
3 There shall be a flfty-fmve (55) foot bumldmng and
dumpster setback from the southern property lmne
4 Llghtmng shall not directly mllummnate adjolnmng proper-
ty
~ That the City's off~cmal zonmng map ms hereby
amended to show the change mn zoning dlstrmct classmfmcatmon
~ That any person vmolatmng any provmsmon of thms
ordmnance shall, upon convmctmon, be fmned a sum not exceedmng
$2,000 00 Each day that a provmslon of th~s ordmnance is v~olated
shall constmtute a separate and distinct offense
SECTION IV That this ordinance shall become effective four-
teen (14) days from the date of its passage, and the City Secretary
is hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record-Chronicle, a daily newspaper
published in the City of Denton, Texas, within ten (10) days of the
date of its passage
