AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING ORDINANCE 85-59
BY APPROVING A DETAIL PLAN FOR A 10 00 ACRE TRACT OF LAND WITHIN
THE PLANNED DEVELOPMENT 42 (PD 42) ZONING DISTRICT CLASSIFICATION
AND USE DESIGNATION, LOCATED NEAR THE EAST SIDE OF MAYHILL ROAD,
APPROXIMATELY 1,800 FEET NORTH OF TREATMENT PLANT ROAD, PROVIDING
FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 FOR VIOLATIONS
THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the Caty of Denton, Texas has applaed for an amend-
ment to Planned Development Distract 42 (PD 42), established by
Ordinance 85-59, and for approval of a detaal plan for a 10 00 acre
tract of land located therein near the east sade of Mayhall Road,
approximately 1,800 feet north of Treatment Plant Road, and
WHEREAS, on April 24, 1996, the Planning and Zonang Commassaon
recommended approval of the requested zoning amendment, and
WHEREAS, the C~ty Council finds that the zoning amendment wall
be in compliance with the Denton Development Plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the detaal plan for a 10 00 acre tract of
land located wzthzn Planned Development Dlstr~ct 42 (PD 42),
legally described ~n Exhzblt A, attached hereto and ancorporated
herein by reference, is hereby approved an accordance with Davasaon
2 of Article IV of Chapter 35 of the Code of Ordanances
~II That the provlsaons of this ordanance govern and
control over any conflicting provision of Ordinance No 85-59
~ IV That a copy of this ordanance shall be attached
to Ordinance No 85-59, showing the amendment herein approved
~ That any person vlolatanG any provasaon of thas
ordanance shall, upon convactaon, be faned a sum not exceedang
$2,000 00 Each day that a provision of this ordinance as v~olated
shall constitute a separate and distinct offense
SECTION VI That thzs ordinance shall become effective four-
teen (14) days from the date of ars passage, and the City Secretary
· s hereby d~rected to cause the caption of th~s ordinance to be
published twlce in the Denton Record-Chronacle, the offaclal news-
paper of the City of Denton, Texas, within ten (10) days of the
date of its passage
