AN ORDINANCE AMENDING THE SCHEDULES OF ELECTRIC RATES CONTAINED IN
ORDINANCE NUMBER 95-178 BY REPEALING THE THERMAL STORAGE INCENTIVE
(SCHEDULE TS); PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING FOR
A SAVINGS CLAUSE, AND PROVIDING AN EFFECTIVE DATE
WHEREAS, at its meeting of April 22, 1996 the Public Utility
Board recommended the elimlnat~on of the Thermal Storage Rate
because it is not cost effective for the purchase of load shift.
WHEREAS, the Clty Council deems it in the public ~nterest to
amend Ordinance 95-178 to ellm~nate the Thermal Storage Rate; NOW
THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION I Ordlnance Number 95-178 adopted pursuant to
Chapter 26 of the Code of Ordinances of the City of Denton relating
to the electric rate schedules is hereby amended by repealing the
Thermal Storage Incentive (Schedule TS) found on page 41 of the
Ordinance.
SE TIO_~ That if any section, subsection, paragraph,
sentence, clause, phrase or word in th~s ordinance, or appl~catlon
thereof to any person or circumstance is held lnvalld by any court
of competent jurisdiction, such holding shall not affect the
valld~ty of the remaining portlons of this ordinance, and the C~ty
Council of the Clty of Denton, Texas, hereby declares it would have
enacted such remaining portions despite any such invalidity.
~ That all provisions of Ordlnance Number 95-178 of
the Clty of Denton in conflict wlth the provlslons of th~s
ordinance are hereby repealed, and all other provls~ons of
Ordinance Number 95-178 of the City of Denton, not ~n conflict w~th
the provisions of this ordinance, shall remain in full force and
effect.
SECTION IV. That th~s ordinance shall become effective
~mmed~ately upon ~ts passage and approval
