1996-142E \WPDOCS~ORD\FILL BOT ORDIN CE NO AN ORDINANCE OF THE CITY OF DENTON AMENDING SECTION 25-5 "SOLICIT- ING BUSINESS OR CHARITABLE CONTRIBUTIONS" OF THE CODE OF ORDINANCES OF THE CITY OF DENTON TO ELIMINATE THE REQUIREMENT THAT PERSONS SOLICITING CHARITABLE CONTRIBUTIONS IN THE PUBLIC STREETS OR ROAD- WAYS SHALL NOT WALK ON THE MAIN TRAVELLED PORTION OF THE ROADWAY, PROVIDING FOR A SEVERABILITY CLAUSE, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, PROVIDING FOR A PENALTY OF A FINE NOT TO EXCEED TWO HUNDRED DOLLARS ($200 00), OR SUCH FINE AS IS SET BY SECTION 552 007(a) OF THE TEXAS TRANSPORTATION CODE FOR VIOLATIONS, AND PROVIDING FOR AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That Section 25-5 2 ,,Regulation of Charitable Solicitations" of the Code of Ordinances of the City of Denton is hereby amended to read as follows Sec. 25-5.2. Regulation of Charitable Solicitations NotwithstandIng any provisions contained ~n section 25-5 or section 25-5 1 of th~s Code, no person shall engage in the following (1) No solicitation shall be permitted along primary arterial roadways Monday through Friday from 7 00 a m to 9 00 a m and from 4 00 p m to 6 00 p m (2) Solicitation shall be prohibited prior to thirty (30) m~nutes after sunrise and after thirty (30) minutes prior to sunset of any day, Monday through Saturday, and shall be prohibited at any t~me on Sunday (3) No one under the age of fourteen (14) years of age shall solicit along primary arterial roadways (4) No person shall solicit w~thout wearing a traffic safety vest and displaying a valid permit upon their person (5) No person shall be exempted from observing all traffic regulations and pedestrIan duties SECTION II That if any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstance is held invalid by any court of competent ]ur~sd~ct~on, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas hereby declares it would have enacted such remaining portions despite any such ~nvalldlty SECTION III That all ordinances or parts of ordinances ~n force when the provls~ons of this ordlnance become effective which are ~nconslstent or in conflict with the terms or provisions contalned in this ordinance are hereby repealed to the extent of any such conflict only, and all other terms and provisions of such prior ordinances not in conflict w~th the provisions shall remain · n full force and effect SECTION IV That any person v~olatlng any provision of this ordinance shall, upon conv$ctlon, be f~ned a sum not exceeding $200 00, or such fine as ~s set by Section 552 007(a) of the Texas Transportation Code Each day that a provision of this ordinance · s v~olated shall constitute a separate and distinct offense SECTION V That th~s ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary ~s hereby d~rected to cause the caption of th~s ordinance to be publlshed twice in the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, w~th~n ten (10) days of the date of ~ts passage ~ PASSED AND DIRECTIVE SECTION REFERENCE NUMBER GENERAL POLICIES AND PROCEDURES 114 01 SUBJECT EFFECTIVE DATE SOLICITATION BY CITY EMPLOYEES REPLACES TITLE SOLICITATION BY CITY EMPLOYEES POLICY STATEMENT Clty offices are for the purpose of conducting City bus~ness To facilitate ~nternal productivity, no employee of the City of Denton may engage ~n political activity, solic- it contributions, sell tickets, or take orders for any cause or function to another City employee or to a member of the general public whlle on duty or in any public building, ~ncludlng coffee rooms and break rooms, or on any public property owned or controlled by the City of Denton or on any private property or otherwise, except to solicit char~- table contributions for the United Way or for the "Fill-the-Boot" Campaigns Employees sol.citing charitable contributions for the United Way or .Fill-the-Boot" Campaigns, e~ther from other City employees or from the general public, are authorized to solicit such contributions either on or off the C~ty facilities on duty and in un~form in ac- cordance with any restrictions set forth under Section 25-5 "Soliciting Bus.ness or Charitable Contributions" of the Code of Ordinances of the City of Denton, or any other applicable laws, rules, or regulations, and subject to the following restrictions i No Clty employee shall be allowed to solicit charitable contributions on duty for more than 24 hours during one calendar year 2 No City employee shall be authorized to solicit charitable contributions on duty when it interferes w~th that employee's regular duties or functions 3 In sol~c~tzng charitable contrlbut~ons on duty, the C~ty employee will comply w~th all other appllcable sections of the Code of Ordinances of the City of Denton and all other City policies, procedures, and regulations The City Manager may also grant exceptions to the prohibition against solicitation and other activitzes hereunder ~n special c~rcumstances Exceptions may ~nclude collections for employees leaving city employment and employees suffering personal hardships I POSTING OF ALL ADVERTISEMENTS, ANNOUNCEMENTS, LEAFLETS A~D ITEMS No other non-3ob related announcement or printed material may be attached to any w~ndow, or buildlng owned by the City of Denton unless approved by the city Manager Announcements and printed material must have the approval of the C~ty Manager to be posed on a City bulletin board Specific technical ]ob related mater~al must be approved by the division manager All items posted must have a removal date in the lower right hand corner The public servxce bulletin board located in the L~brary ~s exempt from th~s policy However, users of the public service bulletin board must adhere to the guidelines established by the Library II DISTRIBUTION OF PRINTED ITEMS TO CITY EMPLOYEES Any printed item, · e , d~scount coupons, tickets, announcements, etc , to be dis- tributed to City employees must be coordinated w~th the Dlrector of Human Resources To obtain approval, a printed item must be C~ty-related bus,ness, or a specific benefit for City employees due to their employment with the City The Human Resources Department w~ll determine the method of d~str~butlng all approved materials
