AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE
FROM PLANNED DEVELOPMENT 117 (PD-117) ZONING DISTRICT CLASSIFI-
CATION AND USE DESIGNATION TO THE SINGLE FAMILY 7 CONDITIONED (SF-
7[C]) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION FOR
52 9693 ACRES OF LAND LOCATED ON THE NORTH SIDE OF ROBINSON ROAD,
APPROXIMATELY 400 FEET WEST OF STATE SCHOOL ROAD, PROVIDING FOR A
PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF,
AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, Mr H Wayne Cooper, on behalf of Robert & Ruth
Mitchell, initiated a change mn zonmng for 52 9693 acres of land
from Planned Development 117 (PD-117) zonmng district classmfmca-
tlon and use deslgnatmon to the Smngle Fammly 7 Condmtmoned (SF-
7[c]) zonmng district classmfmcatlon and use designation, and
WHEREAS, on May 22, 1996, the Planning and Zoning Commission
recommended approval of the requested changes mn zonmng, and
WHEREAS, the Cmty Council finds that these changes mn zonmng
will be mn complmance with the Denton Development Plan, NOW,
THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ That the zonmng dmstrmct classmflcatlon and use
des~gnatlon of the 52 9693 acres of land described mn Exhmbmt 1 ms
changed from Planned Development 117 (PD-117) zonmng dmstrmct
classlfmcat~on and use deslgnatmon to the Smngle Fammly 7 Condm-
tmoned (SF-7) [c] zoning dmstrmct classlfmcatmon and use deslgnatmon
subject to the following condmtmon
That a ten foot (10') wmde bufferyard consmstlng of a slx
foot (6') tall wooden fence, as well as slx (6) canopy
trees and ten (10) understory trees per every 100 linear
feet, or part thereof, be constructed mn the setback
along any Loop 288 frontage Samd bufferyard ms to be
installed at the time bumld~ng permits are mssued for
each mnd~vldual lot havmng frontage along Loop 288
~ That the Cmty's offmclal zonmng map is hereby
amended to show the change in zonmng dlstrmct classmfmcatlon
SECTION III That any person vlolatmng any provision of this
ordmnance shall, upon convmctmon, be fmned a sum not exceedmng
$2,000 00 Each day that a provision of thms ordinance ms vmolated
shall constmtute a separate and dlstmnct offense
ECT~_~IV That thms ordinance shall become effectmve four-
teen (14) days from the date of mrs passage, and the Cmty Secretary
ms hereby dmrected to cause the captmon of this ordmnance to be
published twice in the Denton Record-Chronicle, a dally newspaper
publlshed in the Clty of Denton, Texas, w~th~n ten (10) days of the
date of its passage
