1996-168 NOTE Amended by Ordinance No 99-095 E \WPDOCS~ORD\CABLE BD ORDINANCE NO ~ AI~ ORDINANCE AMENDING SECTION 8-130 OF THE CODE OF ORDINANCES OF THE CITY OF DENTON TO EXPAND THE NUMBER OF MEMBERS OF THE CABLE TV ADVISORY BOARD FROM FIVE TO SEVEN MEMBERS AND TO REDUCE THE TERMS OF SAID MEMBERS FROM THREE TO TWO YEARS, PROVIDING A SAVINGS CLAUSE, AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council deems it in the public interest to expand the number of members of the Cable TV Advisory Board from five to seven members and to reduce the terms of each member from three to two years, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That subsection (b) of Section 8-130 "Authority, Cable TV Advisory Board" of the Code of Ordinances of the City of Denton is hereby amended to read as follows Sec. 8-130. Authority; Cable TV Advisory Board (b) A Cable TV Advisory Board consisting of seven (7) members who shall serve for two year terms, whmch terms shall be staggered, is hereby establmshed Each board member shall be appointed and shall serve at the pleasure of the Council The board shall advise the City Council on its regulatory jurisdiction and shall have the following responsibilities and duties at the direction of the Council (1) Resolving disputes or disagreements between sub- scribers and the grantee after an Investigation, should the subscrmber and the grantee not fmrst be able to resolve their dmspute or dmsagreement The declsmon or findings may be appealed to the City Councml, (2) Revlewmng and auditing all reports and filings submitted to the City as requmred mn this chapter and such other correspondence as may be submmtted to the City concernmng the operatmon of the cable television network, and revmewlng the rules and regulatmons set by the grantee, and (3) Assurmng that all tarmffs, rates, and rules perti- nent to the operatmon of the cable system mn the City are made available for mnspectmon by the public at reasonable hours and upon reasonable requests SECTION II That save and except as amended hereby, all the sections, sentences, and clauses of Section 8-130 of the Code of Ordinances of the City of Denton, Texas shall remain in full force and effect SECTION III That this ordinance shall become effective immediately upon its passage and approval PASSED AND APPROVED this the /~7~ day of ~ , 1996 ~{< ~ILLER, blAYOR ATTEST JENNIFER WALTERS, CITY SECRETARY APPROVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY Page 2 ORDINANCE NO qq-o95 AN ORDINANCE OF THE CITY OF DENTON, TEXAS DISSOLVING THE CABLE TELEVISION ADVISORY BOARD AND REPEALING SECTION 8-130(b) OF THE CODE OF ORDINANCES AND REPEALING ORDINANCE NO 96-168 AND PORTIONS OF ORDINANCE NO 88-182 RELATING TO THE CABLE TELEVISION ADVISORY BOARD AND ANY OTHER ORDINANCE IN CONFLICT WITH THIS ORDINANCE, CONVEYING THE APPRECIATION OF THE COUNCIL TO ALL CURRENT AND FORMER MEMBERS OF THE CABLE TELEVISION ADVISORY BOARD, PROVIDING A SAVINGS CLAUSE, AND PRESCRIBING AN IMMEDIATE EFFECTIVE DATE WHEREAS, by Ordinance No 88-182 and Section 8-130(b) of the Code of Ordinances of the City of Denton, the Council of the City of Denton, Texas established a Cable Television Advisory Board to provide leadership, gmdance, and needed assistance to the City Council in decisions revolving the disputes between subscribers and the cable telemsion fi'anehise holder, to rewew filings, reports, rates, tariffs, and rules of the franchise holder, and to adwse the City Council on its regulatory juns&ctton, and WHEREAS, through its set, ace to the Council and the c~tizens of Denton, the Cable Television Advisory Board proved its worthiness for over a decade, and WHEREAS, as a result of the need to eombme and ehimnate those boards and commissions that have fulfilled their ftmctions and are no longer needed due to City staff bemg able to advise the Council on all aspects of their duty and functions, the City Council deems ~t necessary to chssolve the Cable Television Admsory Board, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That Section 8-130(b) of the Code of Ordinances of the City of Denton, which created the Cable Television Adwsory Board of the City of Denton, is hereby repealed, along w~th Ordinance No 96-168 and those po~ons of Ordmance No 88-182 which create and define the powers and funetnons of the Cable Telexaston Advisory Board Any other ordinances in conflict w~th this ordinance are also repealed to the extent of any such conflict only SECTION H That the Council of the City of Denton, Texas hereby conveys its deepest appreciation to all current and former members of the Cable Talewslon Adwsory Board for their loyal and dedicated serwce to the City Council and the cmzens of Denton SECTION HI That save and except as repealed hereby, all of the sections, clauses, sentences, and phrases of Chapter 8 of the Code of Ordinances of the City of Denton and Ordinance No 88-182 shall remain m full force and effect SECTION IV That tins ordinance shall become effective lmmedmtely upon its passage and approval Page 1 of 2 JACK~JI~R, MAYOR ATTEST JENNIFER WALTERS, CITY SECRETARY APPROVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY/ Page 2 of 2
