AN ORDINANCE OF THE CITY OF DENTON, TEXAS, APPROVING A SPECIFIC USE
PERMIT (S-209) FOR OFF STREET REMOTE PARKING, LOCATED ON 11 503
ACRES OF PROPERTY ON THE WEST SIDE OF CARROLL BOULEVARD AND NORTH
OF THE FAIRGROUNDS, AND CURRENTLY ZONED AS MULTIFAMILY-RESTRICTED
(MF-R) AND MULTIFAMILY-ONE (MF-1) ZONING DISTRICT CLASSIFICATIONS
AND USE DESIGNATIONS, PROVIDING FOR A PENALTY IN THE MAXIMUMAMOUNT
OF $2,000 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE
DATE
WHEREAS, North Texas Fairgrounds lnltmated a request for a
Specific Use Permit for off street remote parking on Lot llC,
Infinity Strata Addition, and which ms currently under Multlfamlly-
restricted (MF-R) and Multlfam~ly-One (MF-1) zonmng dmstrlct
classlflcatmons and use deslgnatmons, and
WHEREAS, on July 31, 1996, the Planning and Zoning Commission
held a publmc hearmng and recommended approval of the requested
Specific Use Permit, and
WHEREAS, in accordance w~th Article III, Division 4, of Chapter
35 of the Code of Ordinances of the Cmty of Denton, Texas, the City
Councz1 finds that all of the following cond~tlons exist
1 That the specific use will be compatible with and not
ln]urlous to the use and en3oyment of other property nor
smgnlfmcantly d~mmnlsh or impair property values within the
immediate vicinity,
2 That the establishment of the specific use wmll not impede
the normal and orderly development and improvement of
surrounding vacant property,
3 That adequate utilities, access roads, dramnage and other
necessary supporting facilities have been or will be
provided,
4. The design, location and arrangement of all driveways and
parking spaces provides for the safe and convenment
movement of vehicular and pedestrian traffzc without
adversely affecting the general public or ad]acent develop-
ments,
5 That adequate nuisance prevention measures have ~een or
will be taken to prevent or control offensive odor, fumes,
dust, no~se and vibratmon,
6 That directional lighting will be provided so as not to
disturb or adversely affect nelghbormng properties, and
7. That there is sufficient landscaping and screening to
ensure harmony and compatibility wlth adjacent property;
NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS'
SECTION I. That specific use permit S-209 is hereby granted
for off street remote parking on 11 503 acres of land, legally
described as Lot llC, Infinlty Strata Addition with the following
condltlons:
1. No direct lighting of residential property
2. No access for vehicle parking to Strata Drive
3. Access for off street remote parking shall only be from the
Fairgrounds or the 30 foot easement on the church property
adjacent to the Fairgrounds.
4. The Planning and Zoning Commission or the City Council may
at anytime revlew th~s speclflc use permit and amend its
provisions, revoke, or suspend it in accordance with the
process of D~vlslon 4, Speclflc Use Permits of Chapter 35,
Code of Ordinances. These amendments, suspenslons, or
revocations shall not require a supermajorlty of the
council to approve
~ That any person v~olat~ng any provision of this
ordinance shall, upon conviction, be f~ned a sum not exceeding
$2,000.00. Each day that a provision of this ordinance is violated
shall constitute a separate and dlstlnct offense.
~ III. That this ordinance shall become effective
fourteen (14) days from the date of its passage, and the City
Secretary is hereby directed to cause the caption of this ordinance
to be published twice in the Denton Record-Chronicle, a dally
newspaper published in the City of Denton, Texas, wlthln ten (10)
days of the date of lts passage.
