AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE
FROM THE GENERAL RETAIL (GR) ZONING DISTRICT CLASSIFICATIONAND USE
DESIGNATION TO THE COMMERCIAL CONDITIONED (C[c]) ZONING DISTRICT
CLASSIFICATION AND USE DESIGNATION FOR 0 82 ACRES OF LAND LOCATED
AT 1815 W UNIVERSITY DRIVE, PROVIDING FOR A PENALTY IN THE
MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING
FOR AN EFFECTIVE DATE
WHEREAS, Ron Yeary mnltlated a change mn zonmng for 0 82 acres
of land from the General Retaml (GR) zoning dmstrlct classmfmcatmon
and use deslgnatmon to the Commercial Condltmoned (C[c]) zoning
dmstrlct classlflcatmon and use designation, and
WHEREAS, on July 24, 1996, the Planning and Zoning Commmsslon
recommended approval of the requested change, and
WHEREAS, the City Council finds that the change mn zonmng wmll
be in compliance with the Denton Development Plan, NOW, THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the zoning dmstrmct classmflcatlon and use
designatIon of the 0 82 acres of land legally descrmbed as shown mn
Exhibit 1, attached hereto and incorporated here~n by reference, ms
changed from the General Retail (GR) zonmng dlstrmct and use
classification to the Commercial Condmtloned (C[c]) zoning dmstrmct
class~fmcatlon and use deslgnatmon under the comprehensmve zoning
ordinance of the City of Denton, Texas, subject to the followIng
conditions
1 That any lmghtmng on the property shall be desmgned and
maintained so as not to shmne on, or otherwise disturb
surroundIng resmdent~al property
2 Exterior lmghtlng is proh~bmted wmthln twenty-five feet
of the south property lmne
3 Owner and occupants shall maintain all existing fencmng
and screening on the property
4 Owner and occupants shall ma~ntamn all exmstmng landscap-
ing on the property
5 That the uses described mn Exhmbmt 2, attached hereto and
incorporated by reference here~n, are prohmbmted
SECTION II That the City's official zoning map is amended to
show the change in zoning dmstr~ct classmf~catmon
SECTION III That any person violating any provision of this
ordinance shall, upon conviction, be fined a sum not exceeding
$2,000 00 Each day that a provision of this ordinance is violated
shall constitute a separate and distinct offense
SECTION IV That this ordinance shall become effective four-
teen (14) days from the date of its passage, and the City Secretary
is hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record-Chronicle, a dally newspaper
published in the City of Denton, Texas, within ten (10) days of the
date of its passage
