AN ORDiNANCE PROVIDiNG FOR THE EXPENDITURE OF FUNDS FOR PURCHASES OF
MATERIALS OR EQUIPMENT WHICH ARE AVAILABLE FROM ONLY ONE SOURCE IN
ACCORDANCE WITH THE PROVISIONS OF STATE LAW EXEMPTING SUCH PURCHASES
FROM REQUIREMENTS OF COMPETITIVE BIDS, AND PROVIDING AN EFFECTIVE
DATE
WHEREAS, Section 252 022 of the Local Government Code prowdes that procurement of aems
that are only avadable from one source, ~ncludlng aems that are only avmlable from one source
because of patents, copyrights, secret processes or natural monopolies, films, manuscripts or books,
electrlcay, gas, water and other utility purchases, captive replacement parts or components for
equipment, and library materials for a public library that are avmlable only from the persons holding
exclusive distribution rights to the materials, need not be submitted to competitive bids, and
WHEREAS, the City Council wishes to procure one or more of the items mentioned ~n the above
paragraph, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTLON_I That the following purchases of materials, eqmpment or supphes, as described ~n
the "Purchase Orders" attached hereto, are hereby approved

SECTION II That the acceptance and approval of the above items shall not constitute a contract
between the City and the person submitting the quotation for such items until such person shall
comply with all reqmrements specified by the Purchasing Department

the items spemfied in Section I and the expenditure of funds pursuant to said contracts is hereby
authorized
SECTION IV That this ordinance shall become effective lmmedmtely upon ~ts passage and
approval

RECOMMENDATION. We recommend th~s purchase order #67375 to Paradigm Traffic
Systems in the mount of $38,722 00 be approved
SIJMMARY: Th~s purchase is for the acqmsltlOn of Peek Transyt traffic controllers These
controllers are a sole source purchase avmlable only from Peek Transyt Corporation which is
distributed m Texas only by Paradigm Traffic Systems The Peek Transyt brand ~s the only
controller compatible with the City of Denton's closed traffic loop Software and design are
protected by copyrights and patents Purchase of sole source materials are exempt from the bid
process by Texas Local Government Code Chapter 252, Section 252 022
The controllers being purchased at this t~me will be used in upgrading units which have become
unrehable due to age or lightening damage Two controllers are for new intersections, one at Kings
Row at Loop 288 and the other at Bonnie Brae at Oak and Hmkory One controller will replace a
unit at Bell and Withers which was struck by a motorist The Risk Retention Fund is ftmd~ng this
replacement but will be reimbursed by the motorist's insurance company

For several years, Paradigm Traffic Systems has been the only suppher of PEEK Traffic
equipment m our area The City of Denton made a comrmtment to tins manufacturer and now
have all but two intersections running with PEEK eqmpment Standardization o f signal
eqmpment allows for qmcker responses to problems encountered by techmcmns wlnle
troubleshooting
The controllers being purchased on hne item one are for replacement of older equipment along
Carroll Blvd Tins will asstst m keeping Denton's major s~gnal systems w~th the latest technology
Umvers~ty Drive has already been upgraded to the SC3000 controllers using Congestion
M~t~gat~on and A~r Quahty grant funding
Several oftbe controllers on line ~tem one will be used as replacements for controllers that are
damaged by hghtenmg or have continuing fadures due to the controller itself Tins reduces down-
ttme at the intersection and allows continued operation
The equipment being purchased against hne item two w~ll be used at two new intersections
Kings Row at Loop 288 and Bonme Brae at Oak and Hickory will be constructed later tins year
using CIP funds and tins ts the tmtml purchase toward the coastructton of these intersections
Line Three ~s the Rtsk Retention Fund used for replacement of equipment revolved m traffic
accidents The cabinet hsted on the P O was struck by a motorist on July 11, 1996 at the
intersection of Bell and Withers These funds wall be retmbursed to the Rtsk Retention Fund by
the insurance company of the motorist at fault
