CE NO -tqo AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING ORDINANCES 85-59 AND 96-103 BY APPROVING A CORRECTED LEGAL DESCRIPTION APPLICABLE TO ORDINANCE 96-103, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City of Denton, Texas applied for an amendment to Planned Development Dlstrlct 42 (PD 42), established by Ordinance 85-59, and for approval of a detail plan for a 10 00 acre tract of land located therein near the east s~de of Mayh~ll Road, approxi- mately 1,800 feet north of Treatment Plant Road, and WHEREAS, on April 24, 1996, the Planning and Zoning Commission recommended approval of the requested zoning amendment, and WHEREAS, the Clty Councll found that the zoning amendment was · n compllance w~th the Denton Development Plan, and approved Ordinance 96-103 to effect the change in zoning with respect to sa~d 10 00 acre tract, and WHEREAS, ~t was subsequently discovered that the legal des- crlpt~on attached to Ordinance 96-103 contained a minor error, and WHEREAS, the C~ty Council f~nds that the error was m~nor and not material to any zoning uses allowable on the property, nor to any prior dec~slon to zone or rezone the property, and that Ordinance 96-103 should be further amended to correct the legal description attached thereto, NOW, THEREFORE, THE COI/NCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That Ordlnance 96-103 is hereby amended by replacing the legal description attached thereto w~th the legal description attached hereto and lncorporated herein as Exhlblt 1 ~ That the provisions of this ordinance govern and control over any conflicting provision of Ordinance Nos 85-59 or 96-103 ~III That a copy of th~s ordinance shall be attached to Ordinance Nos 85-59 and 96-103, showing the amendment here~n approved S CT_~ IV That thzs ordznance shall become effective lmmedzately upon zts passage and a~proval PASSED AND APPROVED thzs 5IAi/ day of~.~' P-'"~ ~'' 1996 ATTEST JENNIFER WALTERS, CITY SECRETARY HERBE~TY~ CITY ATTORNEY PAGE 2 ~e (10 Acre T t) ,L that certain lot, tract or parcel of land l¥1ng and being situated in the .lty and County of Denton, State of Texas, in the Gideon Walker Survey, Abstract 1330 and beIng part of a 84.8193 acre tract conveyed from D.J.
