AN ORDINANCE ORDERING AN EMERGENCY ELECTION TO BE HELD IN THE CITY
OF DENTON, TEXAS, TO FILL A VACANCY IN PLACE 2, ON NOVEMBER 23,
1996, SUBJECT TO GOVERNOR PROCLAIMING THIS AS ANEMERGENCY ELECTION
UNDER SECTION 41 0011 OF THE TEXAS ELECTION CODE, AND, IF A RUNOFF
ELECTION IS REQUIRED, ON DECEMBER 21, 1996, FOR THE PURPOSE OF
ELECTING A COUNCILMEMBER TO PLACE 2 OF THE CITY COUNCIL OF THE CITY
OF DENTON, TEXAS, PROVIDING RESCINDER OF THIS ORDINANCE IN THE
EVENT THAT THE GOVERNOR DECLINES TO AUTHORIZE THE ELECTION, DESIG-
NATING VOTING PLACES AND APPOINTING ELECTION OFFICIALS, PROVIDING
FOR BILINGUAL NOTICE OF THE ELECTION, PROVIDING NOTICE OF THE
FILING DEADLINE FOR A PLACE ON THE SPECIAL ELECTION BALLOT, OR-
DERING THAT AN ELECTRONIC VOTING SYSTEM BE USED, AND PROVIDING FOR
AN EFFECTIVE DATE
WHEREAS, Counc~lmember Jeff Krueger has submitted his res~gna-
tlon as Counc~lmember for Place 2 and, by Resolution No R96-057
passed by the C~ty Council on September 24, 1996, the Council has
accepted Counczlmember Krueger's reszgnatlon, creating a vacancy in
Place 2 under Section 201 023 of the Texas Elect~on Code, and
WHEREAS, the City Council has requested that Governor George
Bush authorzze the City to hold thzs elect~on on a date prior to
the next unzform elect~on date by proclazm~ng th~s an emergency
elect~on under Section 41 0011 of the Texas Election Code, NOW
THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That an emergency municipal elect~on ~s ordered to
be held zn the Czty of Denton, Texas, on Saturday, November 23,
1996, for the purpose of electzng a Councllmember for Place 2,
subject to Governor George Bush proclaiming th~s as an emergency
elect~on under Sectlon 41 0011 of the Texas Election Code In the
event a runoff zs requzred, the runoff elect~on shall be held on
Saturday, December 21, 1996
S CT_~II That, in the event that the Governor declines to
authorize the speczal elect~on, all declared action in th~s
ordinance shall be thereby rescinded, and thzs ordinance shall
become null, void, and of no legal consequence
~ That the pollzng places, which shall be open from
7 00 a m to 7 00 p m, shall be as follows

SECTION IV That the elect~on officials for the election and
the runoff, if any, shall be as follows
For District No 2 Dor~s Chlpman, Presiding Judge and Mary
Mecay, Alternate Judge
Jennifer Walters, City Secretary, shall conduct early voting
under the Texas Election Code
George Hopkins shall be Presiding Judge for the Early Ballot
Board
The presiding judges are authorized to appoint a sufficient
number of clerks as necessary to assist them in the election,
including b~l~ngual assistants as required by law The rate of pay
for election 3udges and clerks shall be the maximum amount provided
for by State law
S CTI~ That early voting shall be conducted for the
election, and the runoff election if necessary, by the Office of
the city Secretary in the Municipal Building at 215 East McKlnney
Street in the City of Denton, Texas The polls for early voting by
personal appearance shall be open between the hours of 8 00 a m
and 5 00 p m Monday through Friday, commencing on November 4,
1996, and ending on November 19, 1996 In addition, early voting
shall be held on Saturday, November 9, 1996, between the hours of
10 00 a m and 3 00 p m , at the same location as weekday early
voting
~ VI That the Mayor is hereby directed to provide
notice of the election, and the runoff election if necessary,
accordance with Sections 4 002 and 4 003 of the Texas Election
Code, the notice to be printed in the Spanish language and the
English language
SECTION VII That, pursuant to Tex Elec Code §201 054, the
deadline for application for a place on the special election ballot
shall be 5 00 p m , Wednesday, October 23, 1996
SECTION VIII That an electronic voting system, meeting the
requirements of Chapter 124 of the Texas Election Code, shall be
used for said election
~ That the City Secretary is authorized to prepare
the official ballot for the election and perform every act required
by the Charter and laws of the State of Texas for holding elec-
tions

diately upon its passage and approval
