1996-273FILE REFERENCE FORM [ 96-273I Additional File Exists Additional File Contains Records Not Public, According to the Public Records Act Other FILE(S) Date Initials Repealed by Ordinance No. 2004-103 04/06/04 J P- ORDINANCE NO q~- ~-~3 AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES LrNDER THE PROVISIONS OF SECTION 545 356 OF THE TRANSPORTA- TION CODE, V T C A , UPON HIGHWAY NO 2181 OR PARTS THEREOF, WITHIN THE INCORPORATED LIMITS OF THE CITY OF DENTON, PROVIDING FOR A PENALTY NOT TO EXCEED TWO HUNDRED DOLLARS ($200 00), PROVIDING FOR A SEVERABILITY CLAUSE, PROVIDING FOR A REPEALING CLAUSE, AND DECLARING AN EFFECTIVE DATE WHEREAS, Sectmon 545 356 of the Transportation Code, V T C A , provides that whenever the governing body of the Cmty shall determine upon the basis of an englneermng and traffmc ~nvestmga- tmon that any prmma facme speed theremn set forth ms greater or less than ms reasonable or safe under the condztmons found to exmst at any intersection or other place or upon any part of a street or highway within the Cmty, taking mnto conslderatmon the width and condmtmon of the pavement and other cmrcumstances on such portion of said street or hmghway, as well as the usual traffic thereon, sa~d governmng body may determine and declare a reasonable and safe prima facle speed lmmmt thereat or thereon by the passage of an ordmnance, whmch shall be effectzve when approprmate smgns g~vlng notzce thereof are erected at such lntersectmon or other place or part of the street or hmghway, NOW THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I Based upon an engmneermng and traffic mnvestlgatlon heretofore made as authorized by the provmsmons of Sectmon 545 356 of the Transportation Code, V T C A , the followmng prmma facme speed llmmts are hereby determmned and declared to be prmma facme reasonable and prudent, and such speed lmmlts are hereby fixed for vehmcles, travelmng upon the following named highways, or parts thereof, descrmbed as follows That from and after the effective date of thms speed zone ordi- nance, no motor vehicle shall be operated along and upon Highway No 2181 wmthln the corporate limits of the Cmty of Denton mn excess of the speeds now set forth in the followmng llmmts H~qhwav Extent Speed Lmmmt FM 2181 From mrs mntersectmon w~th the 35 mph centerlmne of U S 77 south for 0 455 mmles From 0 455 mmles south of its 45 mph ~ntersectmon with the centerllne of U S 77 to the intersection of Lmllman M~ller and Teasley Lane From the lntersectmon of Teasley 50 mph Lane and Llllman Mmller south for 0 400 mmles From 0.400 miles south of the 60 mph intersection of Teasley Lane and Lilllan M~ller to the southern city limits. SECTION II. The regulation of the speed of a vehicle under this ordinance does not apply to: (1) an authorized emergency vehicle responding to a call; (2) a police patrol; or (3) a physician or an ambulance responding to an emergency call. SECTION III. An lndividual adjudged guilty of vlolatlng any provlsions of this ordinance, when signs are erected giving not~ce thereof, shall be guilty of a misdemeanor, and punished by a fine not to exceed Two Hundred Dollars ($200.00). ~ Ail ordinances or parts of ordinances in force when the provisions of this ordinance become effective which are Inconsistent or ~n conflict wlth the terms or provisions contained in this ordinance are hereby repealed to the extent of any such conflict, except for school zone ordinances which limit the speed of vehicles for designated t~me periods. SECTION V. That ~f any sectlon, subsectlon, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or c~rcumstance ls held invalld by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of th~s ordinance, and the C~ty Council of the city of Denton, Texas, hereby declares ~t would have enacted such remainlng portions despite any such ~nval~dity. ~ That th~s ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary ~s hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, the official newspaper of the city of Denton, Texas, wlthin ten (10) days of the date of its passage.
