AN ORDINANCE OF THE CITY OF DENTON, TEXAS, APPROVING A SPECIFIC USE PERMIT TO OPERATE A RECREATIONAL VEHICLE PARK ON 4 226 ACRES LOCATED ON THE WEST SIDE OF INTERSTATE 35, APPROXIMATELY 2,200 FEET NORTH OF SCHUYLER ROAD, PLATTED AS LOT 1, BLOCK B, OF THE WESTERN HILLS BUSINESS PARK, AND CURRENTLY ZONED UNDER THE LIGHT INDUSTRIAL (LI) ZONING DISTRICT CLASSIFICATION AND USE DESIGNA- TION, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, R & K Camping ~mbated a request for a Specific Use Permit for a Recreational Vehmle Park on 4 226 acres of land described as Lot 1, Block B, of the Western Hills Bus~ness Park, and currently zoned under the L~ght Industrial (LI) zomng d~stnct classlficabon and use designation, and WHEREAS, on November 13, 1996, the Planning and Zomng Commission recommended approval of the requested Specific Use Permit, and WHEREAS, the C~ty Council finds that the Specific Use Permit ~s ~n comphance w~th the Zomng Ordinance and Denton Development Plan, and WHEREAS, ~n accordance with Article III, D~ws~on 4, of Chapter 3,5 of the Code of Ordinances of the C~ty of Denton, Texas, the C~ty Council finds that all of the following cond~bons ex~st 1 That the specific use w~ll be compatible w~th and not ~njunous to the use and enjoyment of other property nor s~gmficantly d~m~msh or ~mpa~r property values w~th~n the ~mmed~ate v~c~n~ty, 2 That the estabhshment of the specific use w~ll not ~mpede the normal and orderly development and ~mprovement of surrounding vacant property, 3 That adequate ubht~es, access roads, drainage and other necessary supporting fac~hbes have been or w~ll be prowded, 4 The design, location and arrangement of all driveways and parking spaces provides for the safe and convement movement of vehicular and pedestrian traffic w~thout adversely affecting the general pubhc or adjacent developments, 5 That adequate nuisance prevenbon measures have been or w~ll be taken to prevent or control offensive odor, fumes, dust, no~se and vibration, 6, That d~rect~onal hghbng w~ll be provided so as not to dmturb or adversely affect neighboring properties, and 7 That there m sufficient landscaping and screemng to ensure harmony and compat~b~hty w~th adjacent property, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That a specific use permit to operate a Recreational Vehmle Park m granted to R & K Camping for a 4 226 acre tract of land platted as Lot 1, Block B, of the Western H~lls Bus~ness Park, as per the s~te plan attached hereto, ap- proved and incorporated here~n as Exhibit A SECTION II That any person wolat~ng any prows~on of thru ordinance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a prows~on of th~s ordinance m wolated shall constitute a separate and dmt~nct offense SECTION III That thru ordinance shall become effecbve fourteen (14) days from the date of ~ts passage, and the C~ty Secretary ~s hereby d~rected to cause the caption of thru ordinance to be pubhshed twice ~n the Denton Record-Chromcle, a dmly newspaper pubhshed m the C~ty of Denton, Texas, within ten (10) days of the date of ~ts passage PASSED AND APPROVED this the /"]~day of ~ , 1996 ATTEST JENNIFER WALTERS, CITY SECRETARY APISI~OVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY ~PAGE 2 INTERSTATE HIGHWAY 35
