1995-016E:\WPDOCS\ORD\STRTCLOS.O ORDINANCE NO. ~ AN ORDINANCE OF THE CITY OF DENTON, TEXAS DELEGATING AUTHORITY TO THE CITY MANAGER TO TEMPORARILY CLOSE STREETS FOR BLOCK PARTIES AND OTHER SOCIAL FUNCTIONS IN THE PUBLIC INTEREST PROVIDED NO POLICE OR FIRE HAZARD IS CREATED BY SUCH CLOSURE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City controls the streets as trustee for the public and has the duty to maintain the streets and keep them open and free of obstruction; and WHEREAS, the City Council directed staff to streamline the temporary street closure procedure which required Council approval; and WHEREAS, the procedure has been streamlined to provide for the City Manager to approve requests for temporary street closures for block parties and other social functions in the public interest; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION I. The City Manager is hereby authorized to tempo- rarily close a street or part thereof for a social function, neighborhood block party, or social event in the public interest, provided that, in the City Manager's opinion, the closing will not cause a fire, police, traffic, or safety hazard or any undue inconvenience to the public. SECTION II. That the purpose of this ordinance is to authorize the City Manager to temporarily close a street or part thereof when a request is made by an owner or lessee of real property abutting the part of the street to be closed in order to have or hold a social function, block party, or social event in that part of said street. SECTION III. That the social function, block party, or social event, and the temporary closing of said street or part thereof, and the person or persons requesting the temporary closure shall be subject to such conditions, rules, and regulations as the City Manager may deem necessary to preserve public safety, health, and welfare and to insure that all costs of temporary closure includ- ing, but not limited to the renting of barricades, hiring of off duty police officers and cost of cleaning if any, are paid. SECTION IV. That the person or persons requesting the temporary closing of said street or part thereof shall obtain consent to said closure from each owner or lessee of real property abutting the part of the street to be closed. SECTION V. That when the social function, block party, or social event would require exception to the noise ordinance or other exceptions, such approval by the City Council must be obtained prior to the City Manager approving the closure of a street. SECTION VI.
