1995-099a:\canvas.ord ORDINANCE NO. ~ AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE REGULAR MUNICIPAL ELECTION HELD IN THE CITY OF DENTON ON MAY 6, 1995; AND PROVIDING AN EFFECTIVE DATE. THE COUNCIL OF THE CITY OF DENTON, HEREBY ORDAINS: SECTION I. The City Council finds and declares that the May 6, 1995, regular municipal election was duly ordered for the purpose of electing four Councilmembers to Places 1, 2, 3, and 4; that proper notice of said election was duly given and election of- ficials appointed; that the election was duly held and the returns of the election officials have been delivered to the Council, all in accordance with the laws of the State of Texas and the Charter and ordinances of the City of Denton. SECTION II. The official returns of the election officials having been opened, examined and canvassed, and the Council hereby finds and declares that 3,284 ballots were cast at the election, and that the votes cast for each place on the Council were as follows: EARLY VOTING: FOR PLACE 1: Mark Chew 92 votes Carl Gene Young, Sr. 166 votes David Zoltner 55 votes FOR PLACE 2: Jeff Krueger 145 votes FOR PLACE 3: David Biles 118 votes Harold T. Perry 122 votes FOR PLACE 4: Jerry Cott 183 votes Mark Spinks 21 votes REGULAR VOTING: FOR PLACE 1: Mark Chew 158 votes Carl Gene Young, Sr. 89 votes David Zoltner 125 votes FOR PLACE 2: Jeff Krueger 409 votes FOR PLACE 3: David Biles 357 votes Harold T. Perry 305 votes FOR PLACE 4: Jerry Cott 331 votes Mark Spinks 36 votes TOTAL VOTES CAST: FOR PLACE 1: Mark Chew 250 votes Carl Gene Young, Sr. 255 votes David Zoltner 180 votes FOR PLACE 2: Jeff Krueger 554 votes FOR PLACE 3: David Biles 475 votes Harold T. Perry 427 votes FOR PLACE 4: Jerry Cott 514 votes Mark Spinks 57 votes SECTION III. The Council finds and declares that each candi- date listed below received a majority of the votes cast for each place on the Council and that each candidate listed below is hereby declared to be elected to the City Council of the City of Denton: PAGE 2 FOR PLACE 2: Jeff Krueger FOR PLACE 3: David Biles FOR PLACE 4: Jerry Cott and the candidates shall assume the duties of their office on the date that they take the official oath of office. SECTION IV. The Council finds and declares that no candidate received a majority of the votes cast for Place 1 and that a run- off election is hereby ordered to be held, in accordance with the provisions of Ordinance 95-048, on the 3rd day of June, 1995.
