AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE
FROM SINGLE FAMILY - 16 (SF-16) TO PLANNED DEVELOPMENT (PD) ZONING
DISTRICT CLASSIFICATION AND USE DESIGNATION FOR APPROXIMATELY 23.25
ACRES OF LAND LOCATED NORTH OF AND ABUTTING RYAN ROAD ON
FORRESTRIDGE DRIVE; PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT
OF $2,000 FOR VIOLATIONS THEREOF; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Dal-Tech Engineering, Inc., in behalf of Lodge
Construction Co., Inc., has applied for a change in zoning from
Single Family - 16 (SF-16) to the Planned Development (PD) Zoning
District Classlflcatl n and Use Designation and for approval of a
detailed plan for residential uses; and
WHEREAS, on December 8, 1993 the Planning and Zoning Commis-
sion, after a public hearing, recommended approval of the requested
change in zoning and approval of the detailed plan; and
WHEREAS, the city Council finds that the change in zoning and
approval of the detailed plan will be in compliance with the Denton
Development Plan; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:

SECTION I. That the zoning district classlflcatl and use
designation of the 23.25 acres of land described in Exhibit "A",
attached hereto and made a part hereof for all purposes, is changed
from single family - 16 (SF-16) to planned development (PD) zoning
district classification and use designation under the comprehensive
zoning ordinance of the city of Denton, Texas.
SECTION II. That Exhibit "B", attached hereto and made a part
hereof for all purposes, is approved as the Detailed Plan for the
district.
SECTION III. That the district shall be subject to the
following conditions not reflected on the Detailed Plan:
1. A minimum of forty additional trees, 2 inches in diameter
or greater, as approved by the Planning and Development Department,
shall be planted within the 15' setback along Ryan Road to provide
a buffer between the proposed single family residences and Ryan
Road.
SECTION IV. That the city's official zoning map is amended to
show the change in zoning district classification.
SECTION V. That any person violating any provision of this
ordinance shall, upon conviction, be fined a sum not exceeding
$2,000.00. Each day that a provision of this ordinance is violated
shall constitute a separate and distinct offense.
SECTION V. That this ordinance shall become effective fourteen
(14) days from the date of its passage, and the City Secretary is
hereby directed to cause the caption of this ordinance to be pub-
lished twice in the Denton Record-Chronicle, the official newspaper
of the City of Denton, Texas, within ten (10) days of the date of
its passage. ~ ~

Being a tract of land situated in the A. Gibson Survey,
Abstract No. 498, Denton County, Texas and being a part of
"Tract I" of that certain parcel of land described in two
tracts and conveyed by deed from First Texas Savings
Association, to Lodge Construction Company, Inc. recorded in
Volume 1115, Page 221, Deed Records, Denton County, Texas
and being further described as follows~
BEGINNING at a 1/2" iron rod found for corner, said corner
being the Southwest corner of Lot 16, Block A of Estates of
Forrestridge, Section I, an addition to the City of Denton,
Denton County, Texas, according to the plat recorded in
Cabinet I, Page 151, Plat Records Denton County, Texas;
THENCE South 85 degrees, 32 minutes, 05 seconds, East, along
the South line of Block A of said addition, a distance of
1,332.10 feet to a 1/2" iron rod found for corner; said
corner being the Southeast corner of Lot 7, Block C of said
addition;
THENCE South 00 degrees, 37 minutes, 33 seconds West, along
a fence for a part of the distance, a distance of 721.51 feet
to a fence post for corner in the North line of Ryan Road,
said corner being the Southeast corner of said Lodge
Construction Company tract;
THENCE North 89 degrees, 22 minutes, 47 seconds West, along
the North line of said Ryan Road, a distance of 1,315.61 feet
to a 1/2" iron rod found for corner at a fence corner and in
the West line of said survey and in the North line of Ryan
Road, a public roadway, said point being the Southwest corner
of said Lodge Construction Company tract;
THENCE North 00 degrees, 19 minutes, 42 seconds West, along
the West line of said survey and along a fence, a distance of
810.95 feet to the POINT OF BEGINNING and containing 23.25
Acres or 1,012,770 Square Feet of Land, more or less.
