1994-249E:\WPDOCS\0RD\UNITED.REC AN ORDINANCE AMENDING THE 1994-95 ANNUAL BUDGET OF THE CITY OF DENTON BY ACCEPTING FUNDS IN THE AMOUNT OF TEN THOUSAND TWO HUNDRED EIGHTY DOLLARS ($10,280) FROM UNITED WAY OF DENTON AND EXPENDING SUCH FUNDS FOR RECREATIONAL PROGRAMMING FOR LOW-INCOME AND NON- ENGLISH SPEAKING CHILDREN RESIDING IN THE OWSLEY NEIGHBORHOOD; PROVIDING FOR PUBLICATION HEREOF; AND PROVIDINGAN EFFECTIVE DATE. WHEREAS, the United Way of Denton has received funding from Community Development Block Grants to provide scholarships for recreation programming to low-income and non-English speaking children residing in the Owsley neighborhood of Denton who do not have access to parks and recreation facilities; and WHEREAS, the United Way has been unable to locate a social services organization in Denton to provide recreational program- ming; and WHEREAS, the City's Parks and Recreation Department is agree- able to providing a recreational program at the Denia Recreation Center which includes transportation of the selected children to gymnastics and Ju Jit-su classes; and WHEREAS, the City Manager having advised the City Council that such revenue and expenditure was not anticipated prior to the adoption of the 1994-95 Budget and could not have been included in the original budget; and WHEREAS, Sec. 8.08 of the Charter of the City of Denton and §102.009 of the Texas Local Government Code provide a governing body may authorize an emergency expenditure as an amendment to the original budget only in a case of grave public necessity to meet an unusual and unforeseen condition that could not have been included in the original budget through the use of reasonably diligent thought and attention; and WHEREAS, the City Council finds that the failure to expend the funds discussed above will create a grave public necessity and requires the 1994-95 budget be amended to allow the acceptance of funds from the United Way in the amount of Ten Thousand Two Hundred Eighty Dollars ($10,280) and the expenditure of such funds by the Parks and Recreation Department; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON, TEXAS HEREBY ORDAINS: ~ECTION I. That the City Council hereby adopts the findings listed above. SECTION II. That the 1994-95 Budget of the City of Denton, Texas' is hereby amended by accepting revenue in the amount of Ten Thousand Two Hundred Eighty Dollars ($10,280) from the United Way of Denton to provide scholarships for recreational programming for low-income and non-English speaking children residing in the Owsley neighborhood and allocating such funds to the unappropriated fund balance of the Recreation Fund. SECTION III. That the 1994-95 Budget of the City of Denton, Texas is hereby further amended by expending sums from the unappropriated fund balance of the Recreation Fund to the following accounts: Amount Account $6,365 261-031-0062-R005-8026 $ 487 261-031-0062-R005-8061 $ 76 261-031-0062-R005-8064 $2,852 261-031-0062-R005-8112 $ 500 261-031-0062-R005-8502 ~ECTION IV. That the City Secretary is directed to attach a copy of this ordinance to the original budget and cause this amendment to be published once in the Denton Record-Chronicle. SECTION V. That this ordinance shall become effective immed- iately upon its passage and approval.
