1994-2181035hist.ord OR ,'r,,AMO . q q I g AN ORDINANCE OF THE CITY OF DENTON, TEXAS, DESIGNATING THE PROPERTY LOCATED AT 1035 WEST OAK STREET AS A HISTORIC LANDMARK UNDER SECTION 35-215, ARTICLE V OF CHAPTER 35 OF THE CODE OF ORDINANCES; PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 FOR VIOLATIONS THEREOF; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Historic Landmark Commission and the Planning and Zoning Commission of the city of Denton have recommended that the property herein described be designated as a historic landmark in the city of Denton; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION I. That the property located at 1035 West Oak Street, being more particularly described in Exhibit A attached hereto and incorporated herein by reference, is hereby designated as a historic landmark under Section 35-215, Article V of Chapter 35 of the Code of Ordinances of the city of Denton, Texas. SECTION II. That said property herein described shall be indi- cated upon the zoning map of the city of Denton as a historic land- mark by the letter "H", and the property herein described shall be subject to all the terms, provisions and requirements of Section 35-215, Article V of Chapter 35 of the Code of Ordinances of the City of Denton, Texas, and such designation shall be in addition to any other use designation established in the City's zoning ordi- nance applicable to such property. SECTION III. That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION IV. That this ordinance shall become effective fourteen (14) days from the date of its passage, and the city Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, the official newspaper of the city of Denton, Texas, within ten (10) days of the date of its passage. Evers, Jr. as recorded in volume 461, Page 629 of the Deed Records of Denton County, Texas, and being more particularly described as follows: BEGINNING at an iron rod at the intersection of the South line of West Oak Street with the East fine of Welch Street; THENCE North 89 degrees 45 minutes 26 seconds East with the South line of West Oak Street, 170.0Q feet to an iron rod for corner, said corner being South 89 d~grees 45 minutes 26 seconds West, 8.57 feet from a found iron rod at the Northwest corner of a tract of land described by Deed to Boyd et ux as recorded in Volume 1080, Page 122, Deed Records, Denton County, Texas; THENC~ South parallel with the East line of Welch Street, 316.51 feet to an iron rod for corner in the North line of West Hickory Street, said corner being South 89 degrees 51 minutes 43 seconds West, 6.9 feet from the Southwest corner of a tract of land described by Deed to C. Lauderdale et ux as recorded in Volume 2659, Page 441, Real Property Records, Denton County, Texas; THENCE North 89 degrees 51 minutes 43 seconds West with the North line of West Hickory Street, 170.00 feet to an iron rod for corner at the intersection with the East line of Welch Street; THENCE North with the East line of Welch'Street, 316.38 feet to the POINT OF BEGINNING.
