1994-092E:\~PDO¢S\ORD\BERNARD.PRK AN ORDINANCE PROHIBITING THE PARKING OF VEHICLES ON THE EAST SIDE OF BERNARD STREET FROM ITS INTERSECTION WITH SYCAMORE STREET TO ITS INTERSECTION WITH HIGHLAND STREET WHEN SIGNS ARE POSTED; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00); PROVIDING FOR PUBLICATION; AND PROVIDING FOR AN EFFECTIVE DATE. THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION I. That when signs are erected giving notice thereof, no person shall park a vehicle at any time upon the following streets in the city of Denton at any time, to wit: The east side of Bernard Street from its intersection with Sycamore Street to its intersection with Highland Street. SECTION II. That the provisions of Section I prohibiting the parking of vehicles shall apply at all times to the street and part of streets designated therein except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the direction of a police officer of official traffic control device. SECTION III. That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $200.00. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION IV. That if any section, subsection, paragraph, sen- tence, clause, phrase or word in this ordinance, or application thereof to any person or circumstance is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the city Council of the city of Denton, Texas hereby declares it would have enacted such remaining portions despite any such invalidity. SECTION V. That this ordinance shall become effective fourteen (14) days from the date of its passage, and the city Secretary is hereby, directed to cause the caption of this ordinance to be pub- lishedltwice in the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of its passage. SLICE STREETL The west side of Alice Street from its intersection with Congress Street to its intersection with Egan Street. MOUNTS STREET: The west side of Mounts Street from its intersection with Congress Street to its intersection with Anderson Street. The east side of Mounts Street from 150 feet south of the curbline of the southbound lane of Congress Street to 200 feet south of the curbline of the eastbound lane of Con- gress Street. The east side of Mounts Street from 500 feet south of the curbline of the eastbound lane of Congress Street to its intersection with Gregg Street. DENTON STREET_.' That when signs are erected giving notice thereof, no p~rson shall park a vehicle at any time, except for the loading and unloading of students from 7:00 a.m. until 9:00 a.m. and 3:00 p.m. until 5:00 p.m. upon the following streets in the City of Denton, to-wit: ~STREET: The north side of Congress Street from fifty (50) feet west of the curbline of the southbound lane of Denton Street to fifty (50) feet east of the curbline of the northbound lane of Alice Street. The south side of Congress Street from fifty (50) feet west of the curbline of the southbound lane Denton Street to fifty (50) feet east of the curbline of the northbound lane Mounts Street. MOUNTS STREET: The east side of Mounts Street from 200 feet south of the curbline of the eastbound lane of Congress Street to 500 feet south of the curbline of the eastbound lane of Con- gress Street. SECTION III. That when signs are erected giving notice there- of, no person shall park a vehicle, other than a school bus, upon the following portions of streets in the city of Denton, to-wit: DNT~TREET: The west side of Denton Street from 196 feet south of the curbline of the eastbound lane of Congress Street to 640 feet south of the curbline of the eastbound lane of Con- gress Street. SECTION IV. That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $200.00. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION V.
