AN ORDINANCE OF THE CITY OF DENTON, TEXAS, ADOPTING A CITY LOGO TO
BE USED AS THE OFFICIAL LOGO OF THE CITY OF DENTON; PROHIBITING THE
USE OF SUCH LOGO BY ANY PERSON, FIRM, CORPORATION, OR ORGANIZATION,
OTHER THAN THE CITY OF DENTON WITHOUT WRITTEN APPROVAL OF THE CITY
COUNCIL; PROVIDING FOR A PENALTY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on April 5, 1994 the City Council approved the current
official Logo which shall be used on all official city of Denton
materials, equipment, and supplies; and
WHEREAS, application shall be made to copyright this Logo as
the property of the City of Denton; and
WHEREAS, as the official Logo of the City of Denton, the city
Council is of the opinion that the same should not be used by any
other person, firm, or organization for any purpose without written
approval of the city Council; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION I. That the Logo as set forth in the attached Exhibit
"A" is hereby approved and adopted as the official Logo of the city
of Denton. This official Logo shall be used on all city of Denton
flags from this day forward. All equipment, supplies, and
materials ordered or purchased after the effective date of this
ordinance shall reflect this Logo.
SECTION II. That the Logo approved by the City Council of the
city of Denton shall be affixed to the official City Flag and bear
the words "Denton, Texas" underneath the Logo to be displayed
prominently for all to see.
SECTION III. That no person, firm, organization, or corpora-
tion other than the City of Denton shall adopt, use, display, in-
corporate, or appropriate the official Logo of the City of Denton
as any part of any material, equipment, or other matter of such
person, firm, organization, or corporation without written ap-
plication to and approval of the city Council.
SECTION IV. That any person violating any provision of this
ordinance shall, upon conviction, be fined a sum not exceeding Two
Hundred Dollars ($200.00). Each day that a provision of this
ordinance is violated shall constitute a separate and distinct
offense.
SECTION V. That this ordinance shall become effective fourteen
(14) days from the date of its passage, and the City Secretary is
hereby directed to cause the caption of this ordinance to be pub-
lished twice in the Denton Record-Chronicle, the official newspaper
of the city of Denton, Texas, within ten (10) days of the date of
its passage.

WHEREAS, by ordinance 94-074, the City Council approved the

WHEREAS, the City Council desires to remove the requirement
that written application must be made to the City Council and the
City Council's approval obtained before any person, firm, or
corporation shall display the flag; NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION I. That Section III of Ordinance No. 94-074 is
amended to read as follows:
That the standards for the use of the City of Denton Flag are
as follows:
A person, firm, organization, or corporation, other than the
City of Denton, who adopts, uses, displays, incorporates, or
appropriates the official City Flag as any part of any
material, equipment, or other matter of such person, firm,
organization, or corporation should do so in a manner consis-
tent with the Texas Flag Code, Tex. Rev. Civ. Stat.Ann.art. 6139c
(Vernon 1995).
That the standards for the use of the official City Logo when
not affixed to a flag are as follows:
A person, firm, organization, or corporation, other than the
City of Denton who desires to adopt, use, display, incorpo-
rate, or appropriate the official Logo of the City of Denton
as any part of any material, equipment, or other matter of
such person, firm organization, or corporation should make
written application to the City Council and obtain the
approval of the City Council.
SECTION II. That Section IV of Ordinance No. 94-074 is
amended to read as follows:
A person, firm, organization or corporation shall not use,
display, incorporate or appropriate the official Logo of the
City of Denton or the City of Denton Flag in any manner which
would violate any State civil or criminal statute.
SECTION III. That save and except as amended hereby the
remaining sections of ordinance 94-074 shall remain in full force
and effect.
SECTION IV. That this ordinance shall become effective
immediately upon its approval.

TEXAS; PROHIBITING THE USE OF SUCH LOGO BY ANY PERSON, FIRM,

PENALTY NOT TO EXCEED FIVE HUNDRED DOLLARS FOR EACH DAY OF
VIOLATION; PROVIDING FOR A REPEALER; PROVIDING FOR A SEVERABILITY
CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on April 19, 1994, the City Council enacted Ordinance No. 94-074 which
adopted an official Logo to be used on all official City of Denton materials, equipment, and
supplies; and thereafter, on January 9, 1996 the City Council enacted Ordinance No. 96-011
amending Ordinance No. 94-074 in several respects; and
WHEREAS, heretofore the City of Denton has not adopted a separate official Logo for
its municipal electric utility, and at this time desires to do so; which Logo shall be used on all
official Denton Municipal Electric materials, equipment and supplies; and
WHEREAS, in connection with the adoption of this Logo, the City's municipal electric
utility has conducted a poll of City of Denton municipal electric utility ratepayers to determine
which of two proposed Logos presented to them, was the most favored Logo by a majority of the
City of Denton municipal electric utility ratepayers completing ballots and voting therefor, and;
after the close of the poll, all votes were tabulated, and it has been determined that Logo No.
Two received the majority of said votes. The City Council has therefore determined that it
should adopt Logo Number Two, as attached hereto as Exhibit "A", as the official Logo of
Denton Municipal Electric; and
WHEREAS, the foregoing actions of the City Council are consistent with and permitted
by the provisions of Section 1.05 of the City Charter; and
WHEREAS, application shall be made to copyright the Logo as the property of the City
of Denton; and
WHEREAS, as the official Logo of Denton Municipal Electric, the City Council is of the
opinion that the same should not be used by any other person, firm, corporation, or organization
for any purpose without the written approval of the City Manager; NOW, THEREFOR,
TIlE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
~ That the Logo as set forth in the attached Exhibit "A" is hereby approved
and adopted as the official Logo of Denton Municipal Electric. This official Logo shall be
reflected and utilized on all Denton Municipal Electric equipment, supplies, and materials
ordered or purchased after the effective date of this ordinance.
SECTION II: That no person, firm, corporation, or organization, other than the City of
Denton shall adopt, use, display, incorporate, or appropriate the official Logo of Denton
Municipal Electric as any part of any material, equipment, or other matter of such person, firm,
corporation, or organization without written application to and written approval of the City
Manager.
SECTION Ill: That any person, firm, corporation or organization violating any provision
of this ordinance shall, upon conviction, be fined a sum not exceeding Two Hundred Dollars
($200.00). Each day that a provision of this ordinance is violated, shall constitute a separate and
distinct offense.
SECT1ON IV: That all ordinances or parts of ordinances in force when the provisions of
this ordinance became effective, including without limitation, Ordinance No. 94-074, which are
inconsistent or in conflict with the terms or provisions contained in this ordinaoce, are hereby
repealed to the extent of any such conflict.
SECTION V: That if any section, subsection, paragraph, sentence, clause, phrase or
word contained in this ordinance, or application thereof to any person or circumstances is held
invalid by any court of competent jurisdiction, such holding shall not affect the validity of the
remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby
declares it would have enacted such remaining portions despite any such invalidity.
SECTION VI: That this ordinance shall become effective fourteen (14) days from the
date of its passage, and the City Secretary is hereby directed to cause the caption of this
ordinance to be published twice in the Denton Record-Chronicle, the official newspaper of the
City of Denton, Texas, within ten (10) days of the date of its passage.

and adopted as the Official Logo of The City of Denton. This Official Logo shall be reflected
and utilized on all City of Denton, supplies, and materials ordered or purchased atter the
effective date of this ordinance according to policy hereinafter adopted by the City.
SECTION 2. That the Logo as set forth in the attached Exhibit "B" is hereby approved
and adopted as the official Logo for City of Denton Flag. This official Logo for City of Denton
Flag shall be reflected and utilized on the official City of Denton Flag and bear the words
"Dentoni Texas" underneath the Logo to be displayed prominently for all to see. The use of the
official city flag or the logo for City of Denton Flag by any person, firm, organization, or
corporation, other than the City of Denton, in any way as any part of any material, equipment, or
other matter of such person, firm, organization, or corporation shall do so in a manner consistent
with the treatment of the State Flag under theTexas Flag Code, Tex. Rev. Civ. Stat. Ann. Art.
6139c (Vernon 1995) as currently adopted or as hereinafter amended.
SECTION 3. That the current supply of printed materials and publications shall be used
and depleted without regard to any new policy or guidelines hereinafter adopted.
SECTION 4. That no person, firm, corporation, or organization, other than the City of
Denton shall adopt, use, display, incorporate, or appropriate the official Logo of The City of
Denton or the official Logo for City of Denton Flag when not affixed to a flag, as any part of any
material, i equipment, or other matter of such person, firm, corporation, or organization without
written application to and written approval of the City Council.
