1994-069E:\~PDOCS\ORD\K-9.0 AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING PORTIONS OF CHAPTER 6, ARTICLE I, SECTION 6-9 OF THE CODE OF ORDINANCES RELATING TO DOGS RUNNING AT LARGE AND SECTION 6-31 RELATING TO REGISTRATION FEES; PROVIDING AN EXCEPTION TO THE LEASH REQUIREMENT FOR THEWORKAND TRAINING OF POLICE CANINES; PROVIDING AN EXCEPTION TO THE REQUIREMENT OF PAYMENT OF REGISTRATION FEES FOR POLICE CANINES; PROVIDING FOR A REPEAL OF ANY ORDINANCE IN CONFLICT THERE- WITH; PROVIDING FOR A SEVERABILITY PROVISION; PROVIDING FOR A PEN- ALTY INTHE MAXIMUM AMOUNT OF $200.00 FOR VIOLATIONS OF THE PROVI- SIONS HEREOF; PROVIDING FOR A DEFINITION OF POLICE CANINE; AND PROVIDING FOR AN EFFECTIVE DATE. THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION I. That Sec. 6-2 of Chapter 6 of the Code of Ordinances, Denton, Texas, is hereby amended to include the following definition: Police Canine means any dog trained or being trained for law enforcement purposes which is under the care, custody, and control of officers of the Denton Police Department. SECTION II. That Sec. 6-9 of Chapter 6 of the Code of Ordinances, Denton, Texas, is hereby amended to read as fellows: Sec. 6-9. Animals Running at Large - Prohibited. No person shall permit any animal to run at large. However, this section shall not apply to any work or training of any police canines. SECTION III. That Sec. 6-31 of Chapter 6 of the Code of Ordinances, Denton, Texas, is hereby amended to read as follows: Sec. 6-31. Registration and Identification of Dogs and Cats. (b) Procedure and fees. The owner of a dog or cat required to be registered herein shall register such animal each year on forms provided by the animal control officer. Each animal to be registered must have a current rabies vaccination certifi- cate. The registration fee for each animal shall be estab- lished by the city council and on file in the office of the city Secretary. Owners who submit written proof, satisfactory to the animal control officer, that the animal to be registered is incapable of procreation shall be charged a fee established by the city Council and on file in the office of the city Secretary. There shall be no registration fee for any police canine. SECTION IV. Ail ordinances or parts of ordinances in force when the provisions of this ordinance become effective which are inconsistent or in conflict with the terms or provisions contained in this ordinance are hereby repealed to the extent of any such conflict. SECTION V. If any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstance is held invalid by any court of com- petent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the city of Denton, Texas, hereby declares they would have enacted such remaining portions despite any such invalidity. SECTION V. That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $200.00. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION VI. That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, the official newspaper of the city of Denton, Texas, within ten (10) days of the date of its passage. ~d ~ PASSED AND APPROVED this the ay of ~ , 1994.
