1994-199AN ORDINANCE AUTHORIZING THE EXECUTION OF A CHANGE ORDER TO A CON- TRACT BETWEEN THE CITY OF DENTON AND STEELE FREEMAN ; PROVIDING FOR AN DECREASE IN THE CONTRACT PRICE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on OCTOBER 5~ 1993 , the City awarded a contract for DMC CONSTRUCTION in the amount of $ 2~347~000.00 ; and WHEREAS, the City Manager having recommended to the Council that a change order be authorized to amend such contract with respect to the scope and price and said change order being in compliance with the requirements of Chapter 252 of the Local Government Code; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION I. That the change order decreasing the amount of the contract between the City and STEELE FREEMAN , a copy of which is attached hereto, in the amount of FIFTEEN THOUSAND SEVEN HUNDRED THIRTY TWO and 76/100--- Dollars ($ 15~732.76 ), is hereby approved and the expenditure of funds therefor is hereby authorized. Harrell, City Manager SUBJECT: CHANGE ORDER # 5 - PURCHASE ORDER #40402 - STEEL & FREEMAN DMC RENOVATION RECOMMENDATION: We recommend this change order #5 to Steele-Freeman on Purchase Order # 40402 in the credit amount of $15,732.76 be approved. SUMMARY: This credit or deduct change order is the result of savings in the HVAC air test and balance account. The Facilities Management Technicians provided assistance during the project testings and Steele-Freeman obtained quotes for the various test which were below the anticipated cost. This change order changes total project cost to $2,646,197.72. BACKGROUND: Letter of recommendation from Brent Byers, Principal, Corgan Associates Architects; Change Order #5 (deduct $15,732.76). Final release of lien Also included are 3 copies of the final Change Order. This change order, we are pleased to say, results in a $15,733.00 credit to the City of Denton. We assume all these documents will require Council approval and can be acted upon during the same session. To the best of our knowledge, the only outstanding contract requirement is a complete and upda. ted H.VAC test and balance r~e. port. The contractor indicated th~s is being prepared and will be transmitted the week of October 16th. We recommend deferring this to a warrantee status item. We therefore recommend acceptance and request Council action on Change Order No. 5 and approval of the release of retainage funds in the amount of $9,655.24 to the General Contractor, Steele- Freeman. We have enjoyed serving the City of Denton during all phases of this exciting project.
