1994-184dtmrezon.ord ORDINANCE NO. AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE FROM PLANNED DEVELOPMENT DISTRICT 114 (PD-114) TO AGRICULTURAL (A) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION FOR A 15.67 ACRE TRACT LOCATED ON THE NORTHWEST CORNER OF F.M. 2181 AND HICKORY CREEK ROAD; PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 FOR VIOLATIONS THEREOF; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Dwight Thompson Ministries has applied for a change in zoning for a 15.67 acre tract located on the northwest corner of F.M. 2181 and Hickory Creek Road from Planned Development District (PD-114) to Agricultural District (A); and WHEREAS, on September 14, 1994, the Planning and Zoning Com- mission recommended approval of the requested change in zoning; and WHEREAS, the City Council finds that the change in zoning will be in compliance with the Denton Development Plan; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION I. That the zoning district classification and use designation of the 15.67 acre tract of land described in Exhibit A, attached hereto and incorporated herein by reference, is changed from Planned Development District 114 to Agricultural zoning dist- rict classification and use designation under the comprehensive zoning ordinance of the City of Denton, Texas. SECTION II. That the city's official zoning map is amended to show ~he change in zoning district classification. SECTION III. That any person violating any provision of this ordinance shall, upon conviction be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION IV. That this ordinance shall become effective four- teen (14) days from the date of its passage, and the city Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, the official news- paper of the city of Denton, Texas, within ten (10) days of the date of its passage. Connell, Jr. recorded in Volume 3135, Page .436 of the said Real Property Records, in all, a total distance of 1123.04 feet to the Northwest corner of the herein described tract and a reentrant corner of a certaln 58.81 acre tract; THENCE South 88 Degrees 58 Plinutes 20 Seconds East severing the said Thompson tract with a South line of the 58.81 acre tract a distance of 588.36 feet to a point tn the West Right-of-Way of FM 2181 for the most Easterly Southeast corner thereof; THENCE South O0 Degrees Ol Minutes 04 Seconds East wlth the Fmst line of the 54.4788 acre Thompson tract and the Uest Right-of-[;ay of FM 2181 a distance of 181.85 feet to a Right-of-Way post at an angle point therein; THENCE South Ol Degrees 01 Hinutes 40 Seconds West continuing with the said West Right-of-Way of FM 2181 a distance of 955.05 feet to the PLACE OF BEGINNING and enclosing 15.67 acres of land.
