WHEREAS, Mitchell Vexler has applied for a change in zoning for .330 acres of land from Planned Development No. 87 (PD-87) to Single Family-10 (SF-10) zoning district classification and use designation, and approval of a new detailed plan for 9.296 acres of PD-87; and WHEREAS, on October 27, 1993, the Planning and zoning Commission recommended approval of the requested changes in zoning; and WHEREAS, the City Council finds that the changes in zoning will be in compliance with the Denton Development Plan; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION I. That the zoning district classification and use designation of the .330 acres of land described in Exhibit A, attached to and incorporated into this ordinance by reference, is changed from Planned Development No. 87 (PD-87) to Single Family-10 (SF-10) zoning district classification and use designation pursuant to the Comprehensive Zoning Ordinance of the City of Denton, Texas. SECTION II. That a portion of PD-87 not included in the acreage identified in Section I and consisting of 9.296 acres of land described in Exhibit "B", attached to and incorporated into the ordinance by reference, is amended by the approval of a new detailed plan identified in Exhibit "C", attached to and incorpo- rated into this ordinance by reference. SECTION III. That the City's official zoning map is amended to show the change in zoning district classification. SECTION IV. That a copy of this ordinance shall be attached to Ordinance 84-138, showing the amendment herein approved. SECTION V. That the provisions of this ordinance as they apply to the 9.296 acres shown in the detailed plan herein approved, shall govern and control over any conflicting provision of ordinance No. 84-138, but all the provisions of Ordinance No. 84-138 as they apply to that remaining portion of the district not herein amended, shall continue in force and effect and shall apply to the remainder of said district. SECTION VI. That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION VII. WHEREAS, Dale and Craig Irwin, on behalf of Mitchell Vexler, initiated a request to amend an approved detailed plan for 4.708 acres of land currently within Planned Development District Eighty-Seven (PD-87); and WHEREAS, on May 27, 1998, the Planning and Zoning Commission recommended approval of an amendment to an approved detailed plan for 4.708 acres currently within Planned Development District Eighty-Seven (PD-87); and WHEREAS, the City Council finds that the change in zoning will be in compliance with the Denton Development Plan; NOW THEREFORE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION I. That Ordinance No. 93-232, providing approval of a planned development district for 4.708 acres of land as described therein, is hereby amended by approval of an amended detailed plan of the 4.708 acres of land within Planned Development District Eighty- Seven (PD-87) described in Exhibits A, attached hereto and incorporated by reference herein, is approved, and said detailed plan is attached hereto as Exhibit B. The said Detailed Plan (Exhibit B) shall contain the following conditions: 1. Land uses shall be limited to professional, medical, dental or business administrative services, small animal clinic or public park or open space. Total floor area of medical or dental offices shall not exceed 50% of total allowed floor area. 2. Maximum building height shall be one story. 3. Maximum total floor area for all buildings shall not exceed 36,000 square feet. 4. No individual building shall exceed 6,000 feet of floor area. 5. Exterior walls, excluding windows and doors, shall be constructed of brick, brick veneer or other masonry materials. 6. A buffer yard of not less than 20 feet shall be maintained along adjacent residential property. A minimum of 12 tree per 100 lineal feet will be maintained or planted in the buffer yard. No less than 33% of these trees shall be from the City's large tree planting list as included in the Landscape Ordinance. A screening wall of living material or fence of no less than 6 feet in height shall also be required within the buffer yard. 7. All buildings shall have no less than a 6/12 roof pitch and composition shingles. 8. Lighting on the property shall be designed and maintained so as not to shine on, or otherwise disturb, adjoining property or to shine and project upward to prevent the diffusion of light into the night sky. 9. No loading docks shall be permitted. 10. Setbacks shall be 35 feet on the front, 20 feet on the rear, and 10 feet on the side.Signs shall have the following attributes: a. Maximum height of 6 feet; b. Maximum sign area for new individual ground signs of 24 square feet; C. Maximum sign area for all new ground signs within the project of 192 square feet; and d. OOO- AN ORDINANCE OF THE CITY OF DENTON, TEXAS AMENDING ORDINANCE NO. 93- 232 TO PROVIDE FOR A DETAILED PLAN FOR 4.315 ACRES LOCATED WITHIN THE PLANNED DEVELOPMENT 87 (PD-87) ZONING DISTRICT; THE SUBJECT PROPERTY BEING LOCATED AT THE SOUTHWEST CORNER OF SOUTHRIDGE AND LILLIAN MILLER; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000.00 FOR VIOLATIONS THEREOF; AND PROVIDING FOR AN EFFECTIVE DATE (Z-99-092). Ordinance No. 93-232 providing for the approval of a Planned Development Zoning District Classification and Use Designation for the property described as PD-87 is amended by approving the Detailed Plan attached hereto and incorporated herein by reference as Exhibit B for 4.315 acres located within PD-87, more particularly described by the legal description attached hereto and incorporated herein by reference as Exhibit A, subject to the following conditions: 1. Use of the property shall be limited to use as a Bed and Breakfast Inn. A Bed and Breakfast Inn shall be defined as a facility of not more than fourteen rooms wherein overnight accommodations and meals are provided to tourists and vacationers for compensation. The operator of the inn shall live on the premises. The facility may also host small events such as weddings or business meetings. The facility shall be of a residential style and decor. 2. Exclusive of doors and windows, the exterior elevations of the main building shall consist entirely of brick or stone masonry or stucco. Use of outdoor facilities, such as the swimming pool or spa pavilion, shall be limited to the hours between 8 a.m. and 9 p.m. on Sundays through Thursdays and between 8 a.m. and 10 p.m. on Fridays and Saturdays. 5. The capacity of the dining room shall be limited to 36 persons. Food service shall be limited to overnight patrons and their guests, except reservation only dinner food service will be permitted on Thursday, Friday and Saturday nights for other than overnight patrons. No open seating food service is allowed. No food service customers shall be seated after 10 p.m. 6. The sale of alcohol shall be permitted for on-premises consumption only. Alcohol service shall be by private club membership with service limited to overnight patrons of the bed and breakfast and their guests. 7. The applicant shall work with staff to use ground elevation and shrubbery screening to keep light from car headlights from shining into surrounding residential properties. Final approval of such shall be by building inspection department at time of issuance of building permit. 8. Tree preservation on the subject property shall be maximized as shown on the detailed plan. SECTION 2. The provisions of this ordinance as they apply to the 4.315 acres shown in the detailed plan herein approved, shall govern and control over any conflicting provisions of Ordinance No. 93-232, but all the provisions of Ordinance No. 93-232, as they apply to that remaining portion of the district not herein amended, shall continue in force and effect and shall apply to the remainder of said district. SECTION 3. A copy of this ordinance shall be attached to Ordinance No. 93-232 showing the amendment herein approved. SECTION 4.
