AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE
IN ZONING OF 50 041 ACRES OF LAND LOCATED ON THE NORTHEAST CORNER
OF UNIVERSITY DRIVE (HIGHWAY 380) AND MARSHALL ROAD, FROM PLANNED
DEVELOPMENT NO 13 (PD-13) ZONING DISTRICT CLASSIFICATION TO
AGRICULTURAL (A) ZONING DISTRICT CLASSIFICATION AND USE DESIGNA-
TION, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 FOR
VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the Michael C Ramos has applied for a change in zon-
ing for Planned Development No 13 (PD-13) consisting of 50 041
acres of land by rezoning such acreage from Planned Development
(PD) to Agricultural (A) zoning district classification and use
designation, and
WHEREAS, on September 8, 1993, the Planning and Zoning Commis-
sion recommended approval of the requested change in zoning, and
WHEREAS, the City Council finds that the change in zoning will
be in compliance with the Denton Development Plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the zoning district classification and use
designation of the 50 041 acres of land described in Exhibit "A",
which is attached hereto and incorporated herein by reference, is
changed from Planned Development (PD) zoning district classifica-
tion to Agricultural (A) zoning district classification and use
designation under the comprehensive zoning ordinance of the City of
Denton Texas
SECTION 11 That the City's official zoning map is amended to
show t e change in zoning district classification
SECTION III That any person violating any provision of this
ordinance shall, upon conviction, be fined a sum not exceeding
$2,000, Each day that a provision of this ordinance is violated
shall constitute a separate and distinct offense
SE~TION IV That this ordinance shall become effective four-
teen (14) days from the date of its passage, and the City Secretary
is hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record-Chronicle, the official news-
paper of the City of Denton, Texas, within ten (10) days of the
date of its passage

BEING a 50 041 acre tract of land situated in the B B B & C R R Cc Survey,
Abstract No 141, Denton County, Texas and being all of that certain tract of
land conveyed to Resolution Trust Corporation, in its capacity as receiver for
Colonial Savings Association of America as described by deed recorded in Volume
2785, Page 0103, Real Property Records of Denton County, Texas (R P R D C T
said 50 041 acre tract of land being more particularly described as follows:
BEGINNING at a 1/2-inch iron rod set for the point of intersection of the
northerly right-of-way line of U S Highway 380 (a variable width right-of-way)
with the center of Marshall Road (a public road with a variable width right-of-
way) and being the southwest corner of said certain tract of land recorded in
Volume 2785, Page 0103, R P R D C T;
THENCE North 00033 17" East with said public road a distance of 1303 25 feet to
a 1/2-inch iron rod set for corner;
THENCE North 89048 55 East, at a distance of 20 9 feet passing a 4-inch steel
fence corner poet and continuing in all for a total distance of 1333 02 feet to
a 1/2-inch iron rod found for corner and being in a curve to the right having a
radius point that bears South 56046119" West a distance of 7491 70 feet and being
in the westerly right-of-way line of the Atchison, Topeka, and Santa Fe Railroad
(a variable width right-of-way);
THENCE along the westerly right-of-way line of said Atchison, Topeka, and Santa
Fe Railroad the following
Southeasterly with said curve to the right through a central angle of
05039110 for an arc distance of 739 13 feet, a chord bearing of South
30024 06 East and a chord distance of 738 83 feet to a fence poet found for
corner;
South 17°37 14' East a distance of 139 27 feet to a fence poet found for
corner in the easterly line of the aforementioned B B B & C R R Cc
Survey;
THENCE South 00001120 West with the easterly line of said B B B & C R R Cc
Survey a distance of 572 94 feet to a fence corner poet found in the northerly
right-of-way line of the aforementioned U S Highway 380;
THENCE along said northerly right-of-way line as follows:
North 88039 07 West a distance of 96 55 feet to a broken concrete right-of-
way marker found for corner;
North 87059 22' West a distance of 493 05 feet to a broken concrete right-
of-way marker found for corner,
