ORDINANCE NO. '?.3 -
AN ORDINANCE OF THE CITY OF DENTON, TEXAS, CHANGING THE ZONING
DISTRICT CLASSIFICATION FOR 1.156 ACRES OF LAND LOCATED EAST OF
McCORMICK STREET, WEST OF AVENUE A, AND NORTH OF GREENLEE STREET
(COMMONLY KNOWN AS GREENHILL GARDEN APARTMENTS) FROM MULTIFAMILY-1
DWELLING DISTRICT (MF-1) TO PLANNED DEVELOPMENT WITH CONDITION (PD
[c]); PROVIDING FOR THE APPROVAL OF A DETAILED PLAN; PROVIDING FOR
A PENALTY IN THE MAXIMUM AMOUNT OF $2,000.00 FOR VIOLATIONS THERE-
OF; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, blpha Delta Pi Sorority has applied for a change in
zoning for 1.156 acres of land from Multifamily-1 Dwelling District
(MF-1) to Planned Development with condition (PD [c]) zoning dis-
trict classification and use designation and for approval of a
detailed plan for a sorority residence and chapter meeting room;
and
WHEREAS, on December 2, 1992, the Planning and Zoning Com-
mission recommended approval of the requested change in zoning; and
WHEREAS, the City Council finds that the change in zoning will
be in compliance with the Denton Development Plan; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION I.. That the zoning district classification and use
designation of the 1.156 acres of land legally known as Green Hill
Garden Addition and more fully described in Exhibit A attached and
incorporated into this ordinance by reference is changed from Mul-
tifamily-1 Dwelling District (MF-1) to Planned Development with
condition (PD [c]) zoning district classification and use designa-
tion under the comprehensive zoning ordinance of the City of
Denton, Texas.
SECTION I1. That Exhibit B, attached to and incorporated into
this ordinance by reference, is approved as the Detail Plan for
this district.
SECTION III. That the district shall be subject to the fol-
lowing condition:
Sorority members shall not use on-street parking while
attending chapter meetings and functions.
SECTION IV_ That the City's official zoning map is amended to
show the change in zoning district classification.
SECTION V. That any person violating any provision of this
ordinance shall, upon conviction, be fined a sum not exceeding
$2,000.00. Each day that a provision of this ordinance is violated
shall constitute a separate and distinct offense.
SECTION VI. That this ordinance shall become effective four-
teen (14) days from the date of its passage, and the City Secretary
is hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record-Chronicle, the official news-
paper of the City of Denton, Texas, within ten (10) days of the
date of its passage.
