1993-111ORDINANCE NO. 1-3 AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AUTHORIZING THE CITY MANAGER TO ACT ON THE CITY'S BEHALF IN PAYING SETTLEMENTS IN AN AMOUNT NOT TO EXCEED $5,000 AND IN EXECUTING COMPROMISE SETTLEMENT AGREEMENTS AND RELEASES APPROVED AS TO FORM BY THE CITY ATTORNEY IN LAWSUITS FILED BY OR AGAINST THE CITY; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the prompt settlement of lawsuits in which the City has the potential of greater legal exposure is recognized as a fiscally responsible course of action in the best interests of the citizens; and WHEREAS, delays occasioned by accommodation of legal and logis- tical prerequisites to City Council action upon and approval of demands and offers of settlement in small cases may impede the negotiating posture of the City, potentially resulting in missed opportunities to settle a lawsuit under terms most favorable to the City; NOW THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION I. That the City Manager is hereby authorized to act on the City's behalf in paying settlements and in executing Com- promise Settlement Agreements and Releases approved as to form by the City Attorney in lawsuits to which the City is a party re- quiring expenditures of less than $5,000. SECTION II. That this ordinance shall become effective immedi- ately upon its passage and approval.
