1993-104E:\WPD0CS\0RD\HIST0R1C.0 ORDINANCE NO. 93 -16 4/ AN ORDINANCE OF THE CITY OF DENTON, TEXAS, DESIGNATING THE PROPERTY LOCATED AT 120 WEST OAK STREET AS A HISTORIC LANDMARK UNDER SECTION 35-215, ARTICLE V OF CHAPTER 35 OF THE CODE OR ORDINANCES; PRO- VIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 FOR VIOLATIONS THEREOF; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Historic Landmark Commission and the Planning and Zoning Commission of the City of Denton have recommended that the property herein described be designated as a historic landmark in the City of Denton; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION I. That the property located at 120 West Oak Street, being more particularly described in Exhibit A attached hereto and incorporated herein by reference, is hereby designated as a histor- ic landmark under Section 35-215, Article V of Chapter 35 of the Code of Ordinances of the City of Denton, Texas. SECTION II. That said property herein described shall be indicated upon the zoning map of the City of Denton as a historic landmark by the letter "H", and the property herein described shall be subject to all the terms, provisions and requirements of Section 35-215, Article V of Chapter 35 of the Code of Ordinances of the City of Denton, Texas, and such designation shall be in addition to any other use designation established in the City's zoning ordi- nance applicable to such property. SECTION III. That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION IV. That this ordinance shall become effective four- teen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, the official news- paper of the City of Denton, Texas, within ten (10) days of the date of its passage. r4/~_ PASSED AND APPROVED this the 1~ day of CASTLEBERRY, 1993. Oak DATE: April 5, 1993 BeBe Olufsen has submitted her final application for historic landmark designation for 120 W. Oak. Although the building still retains a modern aluminum storefront, extensive sensitive renovation of the upper facade and interior make designation appropriate for this property. Staff recommends approval and commends Ms. Olufsen, who retained Michelle Glaze to research the property and prepare the application, on submitting a complete and thorough architectural and social history of the building.
