1992-109ALL00278\2000.7 NOTE: Amended by 0rdtnance No. 98-245 ORDINANCE AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR APPROVAL OF A DETAILED PLAN FOR A 12.2077 ACRE TRACT OF L~ND BEING A PORTION OF PLANNED DEVELOPMENT NO. 6, ALSO KNOWN AS SAN JACINTO PLAZA AND BEING DESCRIBED AS LOTS 2A, 3A, 5A, AND 6A, BLOCK A, REPLAT PART OF BLOCK A, TOWNSHIP II, PHASE II, CITY OF DENTON, DENTON COUNTY, TEXAS; PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 FOR VIOLATIONS THEREOF; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a 12.2077 acre tract of land is a portion of Planned Development No. 6, adopted by Ordinance 69-35, enacted on the 23rd day of August, 1969, also known as the San Jacinto Plaza and being described as Lots 2A, 3A, 5A, and 6A, Block A, Replat Part of Block A, Township II, Phase II, City of Denton, Denton County, Texas; WHEREAS, the city of Denton has applied for approval of a detailed plan for said 12.2077 acre tract; and WHEREAS, on May 27, 1992, the Planning and Zoning Commission recommended approval of the detailed plan; and WHEREAS, the City Council finds that approval of the detailed plan will be in compliance with the Denton Development Plan; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION I. That Exhibit A, which is attached to and incorporated into this ordinance by reference, is approved as the Detailed Plan for the 12.2077 acre portion of the district which is described as Lots 2A, 3A, 5A, and 6A, Block A, Replat Part of Block A, Township II, Phase II, City of Denton, Denton County, Texas, in accordance with Article IV of Chapter 35 of the Code of Ordinances. SECTION II. That the city's official zoning map is amended to show the change in zoning district classification. SECTION III. That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000. Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense. SECTION IV. That this ordinance shall become effective four- teen (14) days from the date of its passage, and the city Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, the official news- paper of the City of Denton, Texas, within ten (10) days of the date of its passage. WHEREAS, JKW Architects, on behalf of Santander San Jacinto, has applied for an amendment to a portion of the detailed plan set forth in Ordinance 92-109 for a 12.2077 acre tract of land in the planned development (PD) No. 6 zoning district classification and use designation; and WHEREAS, the amendment applies to a 2.602 acre tract known as Lot 6A, Block A, of the Township II, Phase II Addition and a 3.568 acre tract known as Lot 2A, Block A, of the Township II, Phase II Addition; WHEREAS, on July 22, 1998, the Planning and Zoning Commission, after a public hearing, recommended approval of the requested changes; and WHEREAS, the City Council finds that the proposed detailed plan will be in compliance with the Denton Development Plan and Denton Plan Policies; NOW THEREFORE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION I. That Ordinance No. 92-109, providing approval of a planned development district for 12.2077 acres of land as described therein, is hereby amended by approval of a revised detailed plan on a 2.602 acre tract, as shown on the detailed plan attached hereto as Exhibit "B" and referred to as Lot 6A, Block A, of the Township II, Phase II, Addition and approval of a revised detailed plan on a 3.568 acre tract located within the planned development district No. 6, as shown on the detailed plans attached hereto as Exhibit "A" and referred to as Lot 2A, Block A, of the Township II, Phase II, Addition. SECTION II. That the provisions of this ordinance as they apply to the 5.63 acres shown in the detailed plans herein approved, shall govern and control over any conflicting provision of Ordinance No. 92-109, but all the provisions of Ordinance No. 92-109 as they apply to that remaining portion of the district not herein amended, shall continue in force and effect and shall apply to the remainder of the district. SECTION III. That a copy of this ordinance shall be attached to Ordinance Nos. 92-109, showing the amendment herein approved. PAGE SECTION IV.
