AN ORDINANCE AMENDING SECTIONS 2-80 AND 2-81 OF THE CODE OF OR-
DINANCES OF THE CITY OF DENTON CHANGING THE NAME OF THE BEAUTI-
FICATION ADVISORY COMMISSION TO THE KEEP DENTON BEAUTIFUL BOARD,
CHANGING ALL REFERENCES TO THE COMMISSION TO THE BOARD, AMENDING
SECTION 2-81 OF THE CODE OF ORDINANCES OF THE CITY OF DENTON
CHANGING THE NAME OF THE ENFORCEMENT AND BEAUTIFICATION DIVISION TO
THE COMMUNITY IMPROVEMENT DIVISION, PROVIDING FOR A REPEALING
CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON, TEXAS HEREBY ORDAINS
~ That Chapter 2 of the Code of Ordinances of the
City of Denton is hereby amended by amending Sections 2-80 and 2-81
which shall hereafter be and read as follows
Seo 2-80. Keep Denton Beautiful Board.
That the Council hereby establishes the Keep Denton Beautiful
Board The Keep Denton Beautiful Board shall consist of eleven
(11) members to be appointed by the City Council The members
shall be appointed to serve a term of two (2) years, commencing
July 1st of the year appointed, provided that SlX (6) members shall
be appointed each odd-numbered year and five (5) members each even
numbered year The Council shall, when considering the members to
the Board, appoint six (6) members to serve a two (2) year term and
five (5) members to serve a term of one (1) year The Board shall
elect a chair from among its members, who shall serve for one (1)
year or until he or her successor is elected The Board shall
serve without pay and shall adopt such rules as may be necessary
for the regulation of its business and affairs
Bec. 2-81, Duties and Punotions
That the Board shall serve in an advisory capacity to the City
Council and shall be responsible for making recommendations to the
city Council, Planning and Zoning Commission, Public Utilities
Board, Parks and Recreation Board and other appointed boards or
commissions regarding issues and ordinances affecting the appear-
ance and the environment of the city and the entrances ~nto the
City The Board may establish such committees as necessary to
carry out the purpose of the Board The Board shall serve as the
Tree Board for the purposes of implementing the Tree c~ty USA Pro-
gram by making recommendations with respect to the public tree-care
policy for planting, maintenance and removal of public trees and
implementation of a community forestry work plan The Board may
make recommendations to the City council regarding the budget of
the community Improvement~Divislon
~ That all present members of the Beautification
Advisory Commission shall continue to serve their present terms and
in their same capacities as members of the Keep Denton Beautiful
Board
E~ All ordinances or parts of ordinances in force
when the provisions of this ordinances become effective which are
inconsistent or in conflict with the terms or provisions contained
in th~e ordinance are hereby repealed to the extent of any such
conflict

AN ORDINANCE REPEALING ORDINANCE NO 92-093 IN ORDER TO DISSOLVE THE
"KEEP DENTON BEAUTIFUL BOARD", AMENDING CHAPTER 2 "ADMINISTRATION'
ARTICLE VII, "DENTON CODE OF ORDINANCES, CITY OF DENTON, TEXAS
PROVIDING THAT "KEEP DENTON BEAUTIFUL, INC" IS DESIGNATED AS THE
APPROPRIATE AGENCY TO IMPLEMENT THE "TREE CITY USA" PROGRAM,
PROVIDING A SEVERABILITY CLAUSE, PROVIDING A SAVINGS CLAUSE, AND
PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, Ordinance 92-093 was passed on June 2, 1992 creating "Keep Denton Beautiful
Board to help advise the city on environmental and appearance issues and be designated as
board to implement the "Tree City USA" program and
WHEREAS, it has been recommended by the 'Keep Denton Beautiful Board" and the "Parks
and Recreation Board" that the "Keep Denton Beautiful Board" be dissolved, and
WHEREAS, it is recommended that "Keep Denton Beautiful, Inc be designated to implement
the' Tree City USA" program, and
WHEREAS, the City Council finds that it is ~n the public interest that the recommendations
should be accepted, NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 That Ordinance 92-093 is hereby repealed in ~ts entirety and the "Keep Denton
Beautiful Board" is hereby dissolved
SECTION 2 That Chapter 2, ' Administration", Code of Ordinances, City of Denton, Texas, is
hereby amended by adding Sec 2-241 to read as follows
Sec 2-241 Tree C~ty USA
The council hereby designates "Keep Denton Beautiful Inc to serve as the board to
provide implementation for the "Tree City USA' program The recommendations to implement
the Tree City USA program will be made with the cooperation of the appropriate city staff
SECTION 3 That this ordinance shall repeal every prior ordinance m conflict herewith, but
only insofar as the portion of such prior ordinance shall be in conflict, and as to all other sections
of the ordinance not in direct conflict herewith this ordinance shall be and is hereby made
cumulative except as to such prior ordinances or portions thereof as are expressly repealed
hereby
~ That if any prowsions of this ordinance or application thereof to any person or
c~rcumstances is held invalid by any court, such holding shall not affect the vahthty of the
remmmng pomons of th~s ordinance, and the City Council of the City of Denton, Texas hereby
declares that it would have enacted the remalmng portions despite any such lnvahd~ty
SECTION 5 That th~s ordinance shall become effective immediately upon passage and
approval
