ORDINANCE NO ~-~___
AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE
FROM MULTI-FAMILY (MF-1) TO LIGHT INDUSTRIAL (LI-c) ZONING DISTRICT
CLASSIFICATION AND USE DESIGNATION WITH CONDITIONS FOR 19 67 ACRES
OF LAND LOCATED ON THE SOUTH SIDE OF EAST MCKINNEY WITH CONDITIONS,
APPROXIMATELY 635 FEET WEST OF WOODROW, PROVIDING FOR A PENALTY IN
THE MAXIMUM AMOUNT OF $2,000 FOR VIOLATIONS THEREOF, AND PROVIDING
FOR AN EFFECTIVE DATE
WHEREAS, the County of Denton has applied for a change in
zoning for 19 67 acres of land from Multi-Family (MF-1) to Light
Industrial (LI-c) district classification and use designation with
conditions, and
WHEREAS, on February 12, 1992, the Planning and Zoning Commis-
sion recommended approval of the requested change in zoning, and
WHEREAS, the City Council finds that the change in zoning and
approval of the detailed plan will be in compliance with the Denton
Development Plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ That the zoning district classification and use
designation of the 19 67 acres of land described in Exhibit A,
attached to and incorporated into this ordinance by reference, is
changed from Multi-Family (MF-1) to Light Industrial (LI-c) dis-
trict classification and use designation with conditions under the
comprehensive zoning ordinance of the City of Denton, Texas
S~CTION II. That in accordance with Ordinance No 91-078, the
property shall be subject to the following condition
Specified Uses The property may only be used for correc-
tional facilities with a specific use permit, public bulld-
mngs for local, state, or federal governments, and profes-
sional and administrative offices
SECTION III That the City's official zoning map is amended to
show the change in zoning district classificatIon
~ That any person violating any provision of th~s
ordinance shall, upon conviction, be fined a sum not exceeding
$2,000 Each day that a provision of this ordinance is v~olated
shall constitute a separate and distinct offense
~ That this ordinance shall become effective fourteen
(14) days from the date of its passage, and the City Secretary is
hereby directed to cause the caption of this ordinance to be pub-
lished twice in the Denton Record-Chronicle, the offlclal newspaper
of the City of Denton, Texas, w~thln ten (10) days of the date of

CLASSIFICATION AND USE DESIGNATION FOR 64 4155 ACRES OF LAND LOCATED ON
THE SOUTH SIDE OF MCKINNEY STREET AND THE WEST SIDE OF WOODROW LANE,
PROVIDING FOR A SAVINGS CLAUSE PROVIDING FOR A PENALTY IN THE MAXIMUM
AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN
EFFECTIVE DATE (Z 99 035)
WHEREAS, Joseph Santopetro, on behalf of Denton County, has applied for ma amendment
to the con&t~ons of Ordinances 89 171, 92-033, 94 126, and 96-048, which established a
Conditioned L~ght Industrial (LI[c]) zoning district classification and use designation for 64 4155
acres of land, and
WHEREAS, on May 26, 1999, the Planmng and Zonmg Commission considered the
rezomng request and based on a 2 2 vote does not forward a recommendation to the City Council
regarding the requested change m conditions of Ordinances 89 171, 92-033, 94-126, and 96-048
and
WHEREAS, the C~ty Council finds that the change ~n the conditions of Ordinances 89-17l,
92 033, 94-126, and 96-048 wall be ~n comphance w~th the 1998 Denton Plan Pohc~es, and the 1999
Growth Management Strategies and Plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ That the conditions of Ordinances 8%171 92-033 94-126, and 96 048, which
estabhshed conditioned Light Industrial (Ll[c]) zoning d~stnct class~ficattons and use designations
for the subJeCt 64 4155 acre property, described in the legal description attached hereto and
incorporated here~n as Exhibit A, are amended under the comprehensive zomng ordinance of the
C~ty of Denton, Texas, as follows
1 a That only pubhc buildings, including correctional facfi~ttes, for local, state, or federal
governments and professional and adm~mstrat~ve offices be permitted
b That there will be no curb cuts on Ruddell Street
c That a fence will be erected from H~ckory street to the creek along Ruddell Street
~ That the prows~ons of th~s ordinance shall govern and control over any
confhctmg provts~ons of Ordinances 89-171, 92-033, 94-126, and 96 048, but all provxs~ons of
Ordinances 89-171, 92-033, 94-126, and 96 048 as they apply to the remmnmg port~on of the zoning
d~stnct land use regulations not hereto amended, shall continue ~n full force and effect
