1991-174w \alleycle ord 7435 3 8 ORDINANCE NO AN ORDINANCE OF THE CITY OF DENTON AMENDING CHAPTER 20 OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS TO CREATE A DUTY TO KEEP SIDEWALKS, PARKWAYS AND ALLEYWAYS CLEAN, PROVIDING FOR ABATEMENT BY THE CITY FOR FAILURE TO COMPLY, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $500 FOR VIOLATION THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That Chapter 20 of the Code of Ordinances is amended by adding a new section 20-5 to read as follows Sao. 20-5 Duty to keep sidewalk, parkway and alleyway clean It shall be the duty of the owner, tenant or lessee to keep the abutting or adjacent sidewalk, parkway and alleyway clean and free of all weeds, trash, rubbish, filth, and debris and to place such material in trash receptacles as required by this code and failure to comply with the re- quirement of this section shall be and hereby is declared to constitute a nuisance subject to abatement as provided in this Chapter SECTION II That Section 20-81 of Chapter 20 of the Code of Ordinances is hereby amended to read as follows Sec 20-81 Notice of violation If the owner of property fails or refuses to comply with section 20-3, section 20-5, section 20-71, or section 6-88 of this Code, the City shall give written notice of said violation to the property owner The notice shall be de- livered to the owner or mailed to the owner's post office address If delivery in person is not possible or if the owner's post office address is unknown notice shall be given by publication in the City's official newspaper at least twice within ten (10) consecutive days SECTION III That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $500 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense SECTION IV That this ordinance shall become effective four- teen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, the official news- paper of the City of Denton, Texas, within ten (10) days of the date of its passage PASSED and APPROVED theday of Aftgm , 1991 ATTEST JENNIFER WALTERS, CITY SECRETARY , L BY APVED AS/,'YO LEGAL FORM DEBRA A D YOVITCH, CITY ATTORNEY L ~ BY ~Ql a 1(~
