1991-071dtadbdo NOTE Amended by Ordinance No 99-096 ORDINANCE NO AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DENTON, AMENDING SECTION 2-75 OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, PROVIDING FOR THE CHANGES IN THE RESIDENCY REQUIREMENTS OF THE DOWNTOWN DEVELOPMENT ADVISORY BOARD, APPOINTING MEMBERS TO THE BOARD, AND PROVIDING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That Section 2-75 of the Code of Ordinances of the City of Denton is hereby amended to be and read as follows Sao 2-75 Downtown Development Advisory Board The Denton Downtown Development Advisory Board is hereby established The Board shall consist of eleven (11) members, eleven of whom shall be appointed by the City Council and two (2) ex- officio members to be nominated by the Central Business District Association and appointed by the City Council All Members must be residents of Denton except that one ex-officio member may reside in Denton County if he maintains or represents a business within the boundaries of the Central Business District The ex-officio members shall not be entitled to vote Members shall be appointed to serve two (2) year terms, commencing July 1 of the year appointed, provided that seven (7) members shall be appointed to serve each odd-numbered year and six (6) members each even-numbered year Of the initial members appointed, six members shall be appointed to serve a term to expire June 30, 1993 and five members shall be appointed to serve a term to expire June 30, 1992 Members shall serve until their successors are appointed and qualified The Board shall elect a chair from among its members who shall serve for one (1) year or until his successor is elected The Board shall serve without pay and shall adopt such rules as may be necessary for the regulation of its business and affairs SECTION II All ordinances or parts of ordinances in force when the provisions of this ordinance become effective which are inconsistent or in conflict with the terms or provisions contained in this ordinance are hereby repealed to the extent of any such conflict SECTION III That and are hereby appointed as ex-officio members SECTION IV This ordnance shall become effective immediately upon its passage and approval PASSED AND APPROVED this the ~ day of , BOB CASTLEBERRY, MAYOR ATTEST JENNIFER WALTERS, CITY SECRETARY BY APPR VED AS TO LEGAL FORM DEBRA A DRAYOVITCH, CITY ATTORNEY 1991 PAGE 2 ORDINANCE NO 99-0q~7 AN ORDINANCE OF THE CITY OF DENTON, TEXAS DISSOLVING THE DENTON DOWNTOWN DEVELOPMENT ADVISORY BOARD AND REPEALING ORDINANCES 91- 021 91-071, 95-259 AND ANY OTHER ORDINANCE OF THE CITY OF DENTON TEXAS TO THE EXTENT OF ANY CONFLICT, CONVEYING THE APPRECIATION OF THE COUNCIL TO ALL CURRENT AND FORMER MEMBERS OF THE DENTON DOWNTOWN DEVELOPMENT ADVISORY BOARD, AND PRESCRIBING AN IMMEDIATE EFFECTIVE DATE WHEREAS, by Ordinance 91-021, the Council of the City of Denton, Texas established a Denton Downtown Development Advisory Board to provide advice and recommendations to the City Council and other appointed boards or commissions in decisions and issues involving the organization, promotion, appearance, revitalization, and economic development of the downtown area and central business distract, and WHEREAS, through its service to the Council and the citizens of Denton, the Denton Downtown Development Advisory Board proved its worthiness since 1991 which followed prompting the City Council to continue the board and to change its makeup and residency requirements in Ordinance Nos 91-071 and 95-259, and WHEREAS, the duties and functions of the Denton Downtown Development Advisory Board have been assumed by the City of Denton's Economic Development Department and staff including its Main Street Manager, and, as a result, the City Council no longer deems it in the public interest to continue the Board, NOW THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That Ordinance No 91-021, which created the Denton Downtown Development Advisory Board, are hereby repealed, along with Ordinance Nos 91-011tand 95 259 and any other ordinances in conflict with the purposes of this ordinance, to the extent of any such conflict only SECTION II That the Council of the City of Denton, Texas hereby conveys its deepest appreciation to all current and former members of the Denton Downtown Development Advisory Board for their loyal and dedicated service to the City Council and the citizens of Denton SECTION III That this ordinance shall become effective munediately upon its passage and approval PASSED AND APPROVED this the a3 day of 1999 C JACK MI E MAYOR ` ATTEST JENNIFER WALTERS, CITY SECRETARY BY APPROVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY BY < !
