AN ORDINANCE AUTHORIZING THE EXECUTION OF CHANGE ORDER NO 4 TO A
CONTRACT BETWEEN THE CITY OF DENTON AND MARTIN K EBY CONSTRUCTION
CO , INC , PROVIDING FOR AN INCREASE IN THE CONTRACT PRICE, AND
PROVIDING AN EFFECTIVE DATE
WHEREAS, on May 15, 1990, the City awarded a contract for the
construction of certain improvements to Martin K Eby Construction
Cc , Inc in the amount of $4,271,600 00, and
WHEREAS, the City Manager having recommended to the Council
that a change order be authorized to amend such contract with
respect to the scope and price and said change order being in
compliance with the requirements of Chapter 252 of the Local
Government Code, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That Change Order No 4 to the contract between the
City and Martin K Eby Construction Cc , Inc , a copy of which is
attached hereto, in the amount of Seventeen Thousand One Hundred
Seventy-Seven and No/100 ($17,177 00) Dollars, is hereby approved
and the expenditure of funds therefor is hereby authorized
SECTION II That this ordinance shall become effective
immediately upon it passage and approval

portion is $7,510 00 for battery room modifications

The Utilities Staff recommends approval of EBY's proposal
for an adder of $17,177
SUMMARY/BACKGROUND
On May 15, 1990, Denton approved the construction contract
with EBY in the amount of $4,271,600 for the installation of
the turbine and generator units for Lake Lewisville and Lake
Ray Roberts hydroelectric projects
According to the Federal Energy Regulatory Commission (FERC)
licenses No 3939 and No 3940, the Commission reserves the
right to require changes in the projects' works On December
19, 1990, FERC construction inspection raised some concerns
about the battery rooms inside the hydro powerhouses at both
projects According to FERC letter, the rooms shall be fire
resistant and well ventilated directly to the outside
EBY in this proposal is requesting a total increase of
$17,177 to the contract which includes the following $136
for reinforcement within the concrete platform atop of the
spiral stairs, $9,531 for battery room with miscellaneous
revisions at Lewisville project, and $7,510 for battery room
modifications and miscellaneous changes at Ray Roberts
project

The December 11 and 12, 1990, construction inspection
raised concern about the proposed battery areas at the Ray
Roberts and Lewisville hydroelectric Projects Nos. 3939 and
3940, respectively, awhile providing an "eye wash" area is
recognition of the hazard that batteries pose, that alone is
not adequate. Additional requirements are that battery fumss,
gases, and electrolytic spray should not be allowed to escape

Our review of the proposed battery spaces in the power-
houses has indicated changes in the design will be necessary

Completely enclosing this area with a concrete block wall
should solve the enclosure problem; however, ventilation must
also be provided.
Lerieviiiā¢ s94o. Plans show the battery
racks located in a corner of the powerhouse with a grating
overhead. There are no walls around the area and ventilation
is by the plant ventilation system. With this configuration,
batteries are subject to damage from overhead Explosions or
fires in this area could release gases throughout the power-
house. This situation must be corrected by relocation of the
batteries or by enclosing the area and adding ventilation to
the outside
