1991-041bonbra o ORDINANCE NO 91_0T11 AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE FROM AGRICULTURAL "A" TO OFFICE "O" ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION FOR 225,000 SQUARE FEET OF LAND LOCATED ON BONNIE BRAE STREET, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, Robert LeMond has applied for a change in zoning for 225,000 square feet of land on Bonnie Brae Street, south of University Drive, and WHEREAS, the City Council finds that the change in zoning will be in compliance with the Denton Development Plan, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the zoning district classification and use designation of the 225,000 square feet of land described in Exhibit A, attached to and incorporated into this ordinance by reference, is changed from Agricultural "A" to Office "O" zoning district classification and use designation under the comprehensive zoning ordinance of the City of Denton, Texas SECTION II That the City's official zoning map is amended to show the change in zoning district classification SECTION III That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense SECTION IV That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of its passage PASSED AND APPROVED this the-~' day of 22~_ , 1991 ATTEST JENNIFER WALTERS, CITY SECRETARY BY gal LAc1 Q a-„ APPROVED AS TO LEGAL FORM DEBRA A DRAYOVITCH, CITY ATTORNEY BY~ PAGE 2 EXHIBIT A F I E L D N O T E S Approximately 225, 000 square feet of real property situated in the City and County of Denton, State of Texas, being 308 feet of frontage on Bonnie Brae Street and approximately 730 6 feet deep, more particularly described as follows Beginning immediately south of the existing shopping center (said shopping center located at University Drive and Bonnie Brae) on Bonnie Brae Street and continuing in a southerly direction on Bonnie brae Street for a total of 308 feet to a point for corner, Thence 730 6 feet in a westerly direction to a point for corner, Thence in a northerly direction approximately 308 feet to a point for corner, said point for corner being immediately south of the existing shopping center, Thence East 730 6 feet to the Place of Beginning, and containing in all 225,000 square feet of land (The legal description of the real estate, which is the subject of this transaction, will be prepared by the surveyor Such legal description prepared by the surveyor will be used in the deed and other instruments incident to this transaction)
