AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE
FROM AGRICULTURE (A) AND PLANNED DEVELOPMENT (PD-76) TO SINGLE
FAMILY 7 (SF-7) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION
FOR 1.222 ACRES OF LAND LOCATED ON THE NORTH SIDE OF HOWARD COURT
CUL-DE-SAC, AS MORE PARTICULARLY DESCRIBED HEREIN; PROVIDING FOR A
PENALTY IN THE MAXIMUM AMOUNT OF $2,000.00 FOR VIOLATIONS THEREOF;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Metroplex Engineering has applied for a change in
zoning for 1.222 acres of land from agricultural (A) and planned
development (PD-76) to single family (SF-7) zoning district
classification and use designation; and
WHEREAS, on November 14, 1990, the Planning and Zoning
Commission recommended approval of the requested change in zoning;
NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY; ORDAINS:
SECTION I. That the zoning district classification and use
designation of the 1.222 acres of land described in Exhibit "A",
attached hereto and incorporated herein by reference, is hereby
changed from agricultural (A) and planned development (PD-76) to
single family (SF-7) zoning district classification and use
designation under the comprehensive zoning ordinance of the City of
Denton, Texas.
SECTION II. That the Zoning Map of the City of Denton, Texas,
adopted the 14th day of January, 1969, as an Appendix to the Code
of Ordinances of the City of Denton, Texas, under Ordinance No. 60-
1, as amended, is further amended to show the change in the zoning
district classification approved for the property described.
SECTION III. That any person violating any provision of this
ordinance shall, upon conviction, be fined a sum not exceeding
$2,000.00. Each day that a provision of this ordinance is
violated shall constitute a separate and distinct offense.
SECTION IV. That this ordinance shall become effective
fourteen days (14) days from the date of its passage, and the City
Secretary is hereby directed to cause the caption of this ordinance
to be published twice in the Denton Record-Chronicle, the official
newspaper of the City of Denton, Texas, within ten (10) days of the
date of its passage.

Being all that certain 1.222 acre tract or parcel of land conveyed to
First State Bank of Denton by Trustee's deed recorded in Volume 2496,
Page 449 Real Property Records, Denton County, Texas and including Lot
41, Block B of Bellaire Heights Addition, Phase Five, an addition to the
City of Denton according to the plat recorded in Cabinet D, Slide 284,
Plat Records, Denton County, Texas, said 1.222 acre tract being more
particularly described as follows:
Beginning at a found half inch rebar at the southeast corner of said Lot
41;
Thence North 01 degrees 56 minutes 00 seconds East, passing the
northeast corner of said Lot 41 at 47.88 feet and continuing a total
distance of 282.84 feet to a found square tube for the northeast corner
of the herein described tract;
Thence North 87 degrees 31 minutes 50 seconds West a distance of 185.62
feet to a found square tube for the northwest corner of the herein
described tract;
Thence South 01 degrees 53 minutes 32 seconds West a distance of 234.70
feet to a found square tube at the northwest corner of said Lot 41;
Thence South 02 degrees 10 minutes 39 seconds West a distance of 50.00
feet to a found half inch rebar for the southwest corner of said Lot 41;
Thence South 74 degrees 59 minutes 26 seconds East a distance of 103.87
feet to a point for the most southern corner of said Lot 41, being at
the start of a non-tangent curve to the right having a radius of 50.00
feet, a central angle of 122 degrees 36 minutes 18 seconds, and whose
radius point bears South 74 degrees 59 minutes 34 seconds East 80.00
feet;
Thence with said curve, being the north right-of-way of Howard Court, an
arc distance of 106.99 feet to the Point of Beginning, containing in all
1.222 acres of land.
