AN ORDINANCE AMENDING ARTICLE III OF CHAPTER 2 "ADMINISTRATION" OF
THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS BY ADDING A NEW
SECTION 2-39, ENTITLED "CHANGE ORDERS"; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE.
SECTION I. That Article III of Chapter 2 "Administration" of
the Code of Ordinances of the City of Denton, Texas is hereby
amended by the addition of Section 2-39 "Change Orders", which said
section shall hereafter be and read as follows:
Sec. 2-39. Change orders.
(a) After performance of a contract begins, the City Manager is
authorized to approve a change order if necessary to:
(1) make changes in plans or specifications; or
(2) decrease or increase the quantity of work to be
performed or materials, equipment, or supplies to be
furnished.
(b) The City Manager may authorize a change order as provided
in subsection (a), only if it involves a decrease in the
contract price or an increase of Fifteen Thousand Dollars
($15,000) or less. A change order which does not meet
these requirements shall be approved by the City Council.
(c) The total price of a contract may not be increased by a
change order unless provision has been made for the payment
of the added costs. The original contract price may not be
increased by more than twenty-five (25%) percent. The
original contract price may not be decreased by more than
twenty-five (25%) percent without the consent of the
contractor.
SECTION II. That if any provision of this ordinance or appli-
cation thereof to any person or circumstance is held invalid by any
court, such holding shall not affect the validity of the remaining
portions of this ordinance, and the City Council of the City of
Denton, Texas, hereby declares that it would have enacted such
remaining portions despite any such invalidity.
SECTION III. That this ordinance shall become effective
immediately upon its passage and approval.
