1990-145ORDINANCE NO. O'1V5 AN ORDINANCE AMENDING ARTICLE V OF CHAPTER 26 "VEHICLES FOR HIRE" OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS BY AMENDING SECTION 26-65, ENTITLED "DEFINITIONS" TO PROVIDE FOR ADDITIONAL DEFINITIONS; AND AMENDING THE FEES PROVIDED FOR IN SECTION 26-66, ENTITLED "EMERGENCY SERVICE PROVIDED BY FIRE DEPARTMENT; FEES"; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE. THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION I. That Chapter 26 "Vehicles for Hire" of the Code of Ordinances of the City of Denton, Texas is hereby amended by amending Section 26-65 "Definitions," by the addition or amendment of the following definitions: Sec. 26-65. Definitions. Emergency run means the emergency ambulance trip to the place where the emergency exists, and from the place of such emergency to a hospital, medical clinic, or other appropriate destination for the patient. Emergency patient means a person on life support with specialized monitoring equipment, a person using fluid resuscitation or medication or a relatively stable person with a potentially life-threatening condition. Emergency transfer means any transfer which requires the expedient transfer of an emergency patient from a hospital to another hospital facility equipped to deal with the specific needs of the patient. SECTION II. That Chapter 26 "Vehicles for Hire" of the Code of Ordinances of the City of Denton, Texas is hereby amended by amending Section 26-66 "Emergency Service Provided by Fire Department; Fee", which said section shall hereafter be and read as follows: Sec. 26-66. Emergency Service Provided by Fire Department; Fees. (a) The City shall charge the following fees for emer- gency ambulance services provided in response to a call received by the fire department: (1) One hundred twenty dollars ($120.00) base charge per person for an emergency run. Any additional supplies or equipment used for advanced life support will be added to the base charge as outlined in subsection (3) hereof. (2) Three hundred dollars ($300.00) base charge per person for an emergency transfer. There shall be an additional charge of $3.00 per mile for each additional mile traveled for an emergency transfer outside a 100-mile radius of the city limits of Denton. Any additional supplies or equipment used for advanced life support will be added to the base charge as outlined in subsection (3) hereof. (3) Additional fees: Oxygen ..............................$15.00 IV......... 15.00 (additional bags $10.00) Mast Trousers 25.00 Monitor/Defibrillator 25.00 Nitrous Oxide 25.00 Drugs 25.00 Thumper 25.00 Dressing Tray 25.00 (b) The person receiving emergency ambulance service and any person contracting for the service shall be responsible for payment of the fee. In the case of service received by a minor, the parent or guardian of the minor shall be responsible for payment of the fee. SECTION III. That if any provision of this ordinance or application thereof to any person or circumstance is held invalid by any court, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares that it would have enacted such remaining portions despite any such invalidity.
