1990-109ORDINANCE NO. 90 ya AN ORDINANCE AMENDING ARTICLE I OF CHAPTER 9 OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS ("ELECTRICAL CODE") TO PROVIDE FOR ADOPTION OF THE 1990 NATIONAL ELECTRICAL CODE AND ADOPTION OF AMENDMENTS TO THE NATIONAL ELECTRICAL CODE; TO PROVIDE FOR ADDITIONS THERETO; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR A PENALTY IN THE AMOUNT OF $2,000.00 FOR VIOLATIONS THEREFOR; AND PROVIDING FOR AN EFFECTIVE DATE. THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION I. That Section 9-1 of Article 1 of Chapter Nine of the Code of Ordinances of the City of Denton, Texas is hereby amended to read as follows: Sec. 9-1. Adopting National Electrical Code, 1990 Edition; deletions and amendments. The National Electrical Code, 1990 Edition, as recommended by the National Fire Protection Association, a copy of which shall be filed with the office of the City Secretary and available for public inspection, is hereby adopted and designated as the electrical code of the City of Denton, Texas, the same as though said edition of such Code were copied at length herein, subject to the deletions and amendments enumerated hereafter: 1. Section 250-91. Materials, paragraph (a), Grounding Electrode Conductor, the first sentence is hereby amended to read as follows: The grounding electrode conductor shall be copper. 2. Section 250-92. Installation, paragraph (a), is hereby amended to read as follows: (a) Grounding Electrode Conductor. A grounding electrode conductor or its enclosure shall be securely fastened to the surface on which it is carried. A No. 4 (four) copper or larger conduc- tor shall be protected if exposed to severe physi- cal damage. A No. 6 (six) grounding conductor that is free from exposure to physical damage shall be permitted to be run along the surface of the building construction without metal covering or protection where it is securely fastened to the construction; otherwise, it shall be in rigid metal conduit, intermediate metal conduit, rigid nonmetallic conduit, electrical metallic tubing, or cable armor. Grounding conductors smaller than No. 6 (six) shall be in rigid metal conduit, intermediate metal conduit, rigid nonmetallic conduit, electrical metallic tubing, or cable armor. 3. Section 250-93. Size of Direct-Current System Grounding Conductor, paragraph (c), is hereby amended to read as follows: (c) Not Be Smaller Than No. 8 (eight). In no case shall the grounding conductor be smaller than No. 8 (eight) copper. 4. Section 250-94. Size of Alternating-Current Grounding Electrode Conductor. Exception No. 1: Grounded Systems, paragraph (a) and Exception No. 2: Ungrounded Systems, paragraph (a) are hereby amended to read as follows: Exception No. 1: Grounded Systems. (a) Where connected to made electrodes as in Section 250-83 (c) or (d), that portion of the grounding electrode conductor which is the sole connection to the grounding electrode shall not be required to be larger than No. 6 (six) copper wire. Exception No. 2: Ungrounded Systems. (a) Where connected to made electrodes as in Section 250-83(c) or (d), that portion of the grounding electrode conductor which is the sole connection to the grounding electrode shall not be required to be larger than No. 6 (six) copper wire. 5. Table No. 250-94. Grounding Electrode Conductor for AC Systems is hereby amended by deleting the second and fourth columns which relate to aluminum or copper-clad aluminum conductors. 6. Section 250-95. Size of Equipment Grounding Conduc- tors, the first sentence is hereby amended to read as follows: The size of copper equipment grounding conductors shall not be less than given in Table 250-95. PAGE 2 7. Table No. 250-95. Minimum Size Equipment Grounding Conductors for Grounding Raceway and Equipment is hereby amended by deleting the third column and footnote relating to aluminum and copper-clad aluminum. 8. Section 250-97 is hereby amended to read as follows: 250-97. Outline Lighting. Isolated noncurrent- carrying metal parts of outline lighting systems shall be permitted to be bonded together by a No. 14 (fourteen) copper conductor protected from physical damage, where a conductor complying with Section 250-95 is used to ground the group. 9. Section 300-22. Wiring in Ducts, Plenums, and Other Air-Handling Spaces, paragraph (c), Other Space Used for Environmental Air, Exception No. 5 is hereby amended to read as follows: Exception No. 5: This section does not include the joist or stud spaces in dwelling units. 10. Section 305-6. Ground Fault Protection for Person- nel, paragraph (a) is hereby amended to read as follows: (a) Ground-Fault Circuit-Interrupters. All 125- volt, single-phase, 15- and 20-ampere receptacle outlets which are not a part of the permanent wiring of the building or structure and which are in use by employees shall have ground-fault circuit-interrupter protection for personnel. Providing ground-fault circuit-interrupter protection shall be the responsibility of the employee using the outlet and his employer without regard to whether such persons are performing electrical work or are engaged in some other trade on the premises. SECTION II. That Section 9-6(c) of Article 1 of Chapter Nine of the Code of Ordinances of the City of Denton is hereby amended to read as follows: (c) Aluminum wire and copper-clad aluminum wire smaller than No. 2 AWG shall be prohibited. Aluminum wire and copper-clad aluminum wire No. 2 AWG and larger may be used only with approved connectors and terminals. PAGE 3 SECTION III. All ordinances or parts of ordinances in force when the provisions of this ordinance become effective which are inconsistent or in conflict with the terms or provisions contained in this ordinance are hereby repealed to the extent of any such conflict. SECTION IV. Any person who shall violate a provision of this ordinance, or fails to comply therewith or with any of the require- ments thereof, or of a permit or certificate issued thereunder, shall be guilty of a misdemeanor punishable by a fine not exceeding Two Thousand Dollars ($2,000.00). Each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of this ordinance is committed, or continued, and upon conviction of any such violations such person shall be punished within the limits above. SECTION V. That this ordinance shall become effective thirty (30) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of its passage.
