AN ORDINANCE AMENDING CHAPTER 5, ARTICLE I (BUILDING CODE) OF THE
CODE OF ORDINANCES OF THE CITY OF DENTON TO PROVIDE FOR AMENDMENTS
TO SECTION 5-3, BY AMENDING THE 1985 UNIFORM BUILDING CODE THERETO
TO PROVIDE FOR DEMOLITION FEES; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE.
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION I. That Section 5-3 of Article I of Chapter 5 of the
Code of Ordinances of the City of Denton, Texas is hereby amended
to provide a new subsection (7) providing for permit fees, which
said subsection shall hereafter be and read as follows:
Section 5-3. Deletions and Amendments.
(7) Demolition Permit: No demolition permit shall
be issued unless the applicant has paid the
following fee:
For residential structures ................$10.00
For commercial structures 50.00
SECTION II. That if any provision of this ordinance or
application thereof to any person or circumstance is held invalid
by any court, such holding shall not affect the validity of the
remaining portions of this ordinance, and the City Council of the
City of Denton, Texas, hereby declares that it would have enacted
such remaining portions despite any such invalidity.
SECTION III. That this ordinance shall become effective
immediately upon its passage and app~rroo~vJ/al.

ORDINANCES OF THE CITY OF DENTON; AMENDING CHAPTER 28, CODE OF
ORDINANCES, CITY OF DENTON, TEXAS BY ADDING SECTION 28-32 PROVIDING
FOR AN EXEMPTION FROM FEES FOR THE CITY OF DENTON AND POLITICAL
SUBDIVISIONS AND AGENCIES OF THE STATE OF TEXAS AND THE UNITED
STATES OF AMERICA; PROVIDING FOR THE REPEAL OF ALL ORDINANCES THAT
CONFLICT HEREWITH; 'PROVIDING A SEVERABILITY CLAUSE; PROVIDING A
SAVINGS CLAUSE; PROVIDING FOR PUBLICATION; AND PROVIDING AN

THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION I. That Chapter 28, Section 28-28(3) of the Code of Ordinances of the City of
Denton is hereby amended so that said section shall hereafter be and read as follows:
(3) Section 107.2, Permit Fees. Section 107.2 is amended to read as follows:
The applicant shall submit the applicable permit fee as set by City Council by ordinance
and the fee schedule shall be available for public inspection at the offices of the Building Official
and the City Secretary.
SECTION II. That Chapter 28, Section 28-28(4) of the Code of Ordinances of the City
of Denton is hereby amended so that said section shall hereafter be and read as follows:
(4) Section 107.3, Plan Review fees. Section 107.3 is amended to read as follows:
The applicant shall submit the applicable plan review fee as set by City Council by
ordinance, and the fee schedule shall be available for public inspection at the offices of the
Building Official and the City Secretary.
SECTION III. That Chapter 28, Section 28-28(7) of the Code of Ordinances of the City
of Denton is hereby amended so that said section shall hereafter be and read as follows:
(7) Section 108.8, Reinspections. The fourth paragraph of section 108.8 is amended to
read as follows:
To obtain a reinspection, the applicant shall pay the applicable reinspection fee as set by
City Council by ordinance and then request an inspection in the manner prescribed by the
building official.
The fee schedule shall be available for public inspection at the offices of the Building Official
and the City Secretary.
SECTION IV. That Chapter 28, Sections 28-28(9)a. and 28-28(9)b.(1) - (7) of the Code
of Ordinances of the City of Denton are hereby amended so that said section shall hereafter be
and read as follows:
(9) Building Permit Fees.
a. Building Permit Fees for Nonresidential Buildings and Additions and Repairs
to Residential Buildings.
b. Other Inspections Fees.
The City Council shall set a fee schedule for building permit fees and other inspections
fees by ordinance and the fee schedules shall be available for inspection at the offices of the
Building Official and the City Secretary.
SECTION V. That Chapter 28, Section 28-28(10) of the Code of Ordinances of the City
of Denton is hereby amended so that said section shall hereafter be and read as follows:
(10) Permit Fee Schedule for New One- and Two-Family Dwellings.
The City Council shall set a fee schedule for new one and two-family dwellings by
ordinance and the fee schedule shall be available for public inspection at the offices of the
Building Official and the City Secretary.
SECTION VI. That Chapter 28, Sections 28-121(1) - (12) of the Code of Ordinances of
the City of Denton is hereby amended so that said section shall hereafter be and read as follows:
Sec. 28-121 Inspection fees.
The applicant shall submit the applicable electrical inspection fees as set by City Council
by separate ordinance before the issuance of any permit required by this division. The fee
schedule shall be, available for public inspection at the offices of the Building Official and the
City Secretary.
SECTION VII. That Chapter 28, Section 28-210(f) of the Code of Ordinances of the
City of Denton is hereby amended so that said section shall hereafter be and read as follows, and
that Section 28-210(g) is hereby deleted:
(f) The applicant shall pay for each permit issued, at the time of issuance, a
plumbing permit fee as set by City Council by ordinance and the fee schedule shall be available
for public inspection at the offices of the Building Official and the City Secretary.
SECTION VIII. That Chapter 28, Sections 28-252(9) and (10) of the Code of Ordinances
of the City of Denton is hereby amended so that said section shall hereafter be and read as
follows:
(9) Mechanical Permit Fees. Table No. 1-A, Mechanical Permit Fees is amended to
read as follows:
The applicant shall submit the applicable mechanical permit fees as set by City
Council by ordinance and the fee schedule shall be available for public inspection at the
offices of the Building Official and the City Secretary.
(10) Table I-A, Other Inspections and Fees. Table No. 1-A is amended to read as
follows:
The applicant shall submit the applicable inspections, reinspection, and plan
review fees as set by City Council by ordinance and the fee schedule shall be available
for public inspection at the offices of the Building Official and the City Secretary.
SECTION Ix. That Chapter 28, Section 28-297(3) of the Code of Ordinances of the City
of Denton is hereby amended so that said section shall hereafter be and read as follows:
(3) Section 1.8, Schedule of Fees. Section 1.8 is amended to read as follows:
The applicant shall submit the applicable fee for a swimming pool as set by City
Council by ordinance and the fee schedule shall be available for public inspection at the
offices of the Building Official and the City Secretary.
SECTION X. That chapter 28 of the Code of Ordinances, of the City of Denton, Texas is
hereby amended by the addition of Section 28-32 to be hereafter read as follows:
Sec. 28-32. Exemptions from fees.
Not withstanding any other provision of this Chapter or the Building Code, the City of
Denton and any other political subdivision or agency of the State of Texas or the United States
Government shall be exempt from payment of any fees required by this chapter.
SECTION XI. That Ordinances 83-129 and 90-161 of the City of Denton are hereby
repealed.
SECTION XII. That the Fee Schedules set forth in Exhibit "A", containing Tables 1-A,
1-B, 2, 3-A, 3-B, 3-C, 4, 5, and 6, attached hereto and made a part hereof for all purposes, is
hereby adopted and authorized to be imposed for the filing of applications, review, approval,
grant or issuance of permits, inspections, licenses, certificates, variances or designations required
by the "Buildings and Building Regulations"and "Sign and Advertising Devices" as authorized
by Chapters 28 and 33 respectively, of the Code of Ordinances of the City of Denton.
SECTION XIII That this ordinance shall repeal every prior ordinance in conflict
herewith, but only insofar as the portion of such prior ordinance shall be in conflict; and as to all
other sections of the ordinance not in direct conflict herewith, this ordinance shall be and is
hereby made cumulative except as to such prior ordinances or portions thereof as are expressly
repealed hereby.
SECTION XIV. That if any provision of this ordinance or application thereof to any
person or circumstance is held invalid by any court, such holding shall not affect the validity of
the remaining portions of this ordinance, and the City Council of the City of Denton, Texas,
hereby declares that it would have enacted the remaining portions despite any such validity.
SECTION XV. That this ordinance shall become effective on October 1, 1998, and the -
City Secretary is hereby directed to cause the caption of this ordinance to be published twice in
the Denton Record-Chronicle, a daily newspaper published in the City of Denton, Texas, within
ten (10) days of the date of its passage.
