AN ORDINANCE DESIGNATING AND ESTABLISHING SPEED ZONES ON STATE
HIGHWAY FM 426 (MCKINNEY ROAD) FROM NORTHBOUND U S HIGHWAY 77
(LOCUST STREET) TO EASTERN CITY LIMITS FOR A DISTANCE OF 5 151
MILES, PROVIDING FOR A PENALTY OF A FINE NOT EXCEEDING TWO HUNDRED
DOLLARS ($200 00), PROVIDING A SEVERABILITY CLAUSE, AND DECLARING
AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I. That based upon an engineering and traffic
investigation heretofore made as authorized by the provisions of
Tex Rev Civ Stat Ann , art 6701d §169 (Vernon 1977), the
following speed limits are hereby determined and declared to be
prima facie the maximum reasonable and safe speeds for east and
west bound traffic on State Highway F M 426 from northbound U S
Highway 77 to the eastern city limits, and such speed limits are
hereby fixed for vehicles travelling upon the following portions
of Highway, and parts thereof
(a) Beginning at the intersection of U S Highway 77
northbound (Locust Street) thence continuing in
an easterly direction along F M 426 for a
distance of 1 000 mile, approximately, a maximum
speed of 30 miles per hour,
(b) Thence continuing along F M 426 in an easterly
direction for a distance of 515 miles, approxi-
mately, a maximum speed of 35 miles per hour,
(c) Thence continuing along F M 426 in an easterly
direction for a distance of 1 305 miles, approxi-
mately, a maximum speed of 45 miles per hour,
(d) Thence continuing along F M 426 in an easterly
direction for a distance of 2 331 miles, approxi-
mately, said point being at Denton east city
limits, a maximum speed of 55 miles per hour
SECTION II That any person violating any of the provisions
of this ordinance shall, upon conviction, be fined a sum not
exceeding Two Hundred dollars ($200 00), and each day and every
day that the provisions of this ordinance are violated shall
constitute a separate offense This penalty is in addition to and
cumulative of, any other remedies as may be available at law and
equity
SECTION III, That if any section, subsection, paragraph,
sentence, clause, phrase, or word in this ordinance, or application
thereof to any person or circumstance is held invalid by any court
of competent jurisdiction, such holding shall not affect the
validity of the remaining portions of this ordinance, and the City
council of the City of Denton, Texas, hereby declares it would have
enacted such remaining portions despite any such invalidity
SECTION IV. That this ordinance shall become effective
fourteen (14) days from the date of its passage, and the City
Secretary is hereby directed to cause the caption of this ordinance
to be published twice in the Denton Record-Chronicle, the official
newspaper of the City of Denton, Texas, within ten (lo) days of the
date of its passage
