1989-040NO AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE FROM PLANNED DEVELOPMENT (PD) TO TWO-FAMILY DWELLING (2-F) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION FOR 0 209 ACRE OF LAND, LOCATED AT THE SOUTHEAST CORNER OF THE INTERSECTION OF SCRIPTURE STREET AND FRY STREET, AS MORE PARTICULARLY DESCRIBED HEREIN, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, Jay Ballentine has applied for a change in zoning for 0 209 acre of land from Planned Development (PD) to Two-Family (2- F) zoning district classification and use designation, and WHEREAS, on February 8, 1989, the Planning and Zoning commission recommended approval of the requested change in zoning, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the zoning district classification and use designation of the 0 209 acre of land described in Exhibit "A", attached hereto and incorporated herein by reference, is hereby changed from Planned Development (PD) to Two-Family Dwelling (2-F) zoning district classification and use designation under the comprehensive zoning ordinance of the City of Denton, Texas SECTION II That the Zoning Map of the City of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinances of the City of Denton, Texas, under ordinance No 69-1, as amended, is further amended to show the change in the zoning district classification herein approved for the property herein described SECTION III That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2000 00 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense SECTION IV That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of its passage PASSED AND APPROVED this th~~ day of 1989 RAY S HEN , MAYOR ATTEST J NIFER ALTERS, CITY SECRETARY APPROVED AS TO LEGAL FORM DEBRA A DRAYOVITCH, CITY ATTORNEY BY M k7 e '8r'6 EXHIBIT "A" COLEMAN M ASSOC.
