ADDITION AND THE 3 809 ACRES OF LAND LOCATED IN THE JOHN MCGOWAN
SURVEY, ABSTRACT NO 797, AS MORE PARTICULARLY DESCRIBED HEREIN,
PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2000 00 FOR
VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the City of Denton has petitioned for changes in the
district zoning classifications for the properties herein
described, and
WHEREAS, on January 11 , 1989, the Planning and Zoning
Commission recommended approval of the requested changes in zoning,
NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I. That the zoning district classification and use
designation of Block 2, Lots 1-11 of the Southridge Addition, as
recorded in Volume 15, Page 42, of the Plat Records of Denton
County, Texas, and Block 2, Lots 12-22 of the Southridge Addition,
as recorded in Volume 16, Page 30 of the Plat Records of Denton
County, Texas, are hereby changed from Office District (0) to Two-
Family Dwelling District (2-F) classification and use designation
under the comprehensive zoning ordinance of the City of Denton,
Texas
SECTION II That the zoning district classification and use
designation of Block 2, Lot 3 of the Southridge Center Addition,
as recorded in Volume 6, Page 8 of the Plat Records of Denton
County, Texas, is hereby changed from General Retail District (GR)
to Multi-Family Dwelling District (MF-1) classification and use
designation under the comprehensive zoning ordinance of the City
of Denton, Texas
SECTION III, That the zoning district classification and use
designation of Block 3, Lots 1-6, as recorded in Volume 6, Page 30,
of the Plat Records of Denton County, Texas, and Block 4R, Lots
1-11 of the Southridge Center Addition, as recorded in Volume 6,
Page 42, of the Plat Records of Denton County, Texas, are hereby
changed from Office District (O) to multi-Family Restricted
District (MF-R) classification and use designation under the
comprehensive zoning ordinance of the City of Denton, Texas
SECTION IV, That the zoning district classification and use
designation of Block 4, Lots 1A, 1B, and 1C of the Southridge
Center Addition, as recorded in Volume 14, Page 8, of the Plat
Records of Denton County, Texas, are hereby changed from office
District (O) to Two-Family District (2-F) classification and use
designation under the comprehensive zoning ordinance of the City
of Denton, Texas
SECTION V That the zoning district classification and use
designation of the property included in the Hollyhills Addition as
recorded in Volume 10, Page 13, of the Plat Records of Denton
County, Texas, are hereby changed from office District (O) to
Multi-Family Dwelling District-1 (MF-1) classification and use
designation under the comprehensive zoning ordinance of the City
of Denton, Texas
SECTION VI That the zoning district classification and use
designation of the 3 809 acres of land described in Exhibit "A",
attached hereto and incorporated herein by reference, is hereby
changed from office District (O) to Multi-Family Dwelling District-
1 (MF-1) classification and use designation under the comprehensive
zoning ordinance of the City of Denton, Texas
SECTION VII. That the Zoning Map of the City of Denton,
Texas, adopted the 14th day of January, 1969, as an Appendix to the
Code of Ordinances of the City of Denton, Texas, under Ordinance
No 69-1, as amended, is further amended to show the change in the
zoning district classification herein approved for the property
herein described
SECTION VIII That any person violating any provision of this
ordinance shall, upon conviction, be fined a sum not exceeding
$2000 00 Each day that a provision of this ordinance is violated
shall constitute a separate and distinct offense
SECTION IX. That this ordinance shall become effective
fourteen (14) days from the date of its passage, and the City
Secretary is hereby directed to cause the caption of this ordinance
to be published twice in the Denton Record-Chronicle, the official
newspaper of the City of Denton, Texas, within ten (10) days of the
date of its passage

on January 11, 1989, in the Council Chambers of the Municipal Building at

Procedure for a Zoning Petition
A zoning petition follows a two-stage review process that is designed to
provide opportunities for citizen involvement and comment Following
submission of an application for a zoning change, a public hearing is
scheduled before the Planning and Zoning Commission This commission is
composed of seven members appointed by the City Council whose role is to
make recommendations to the Council on zoning requests Property owners
within two hundred feet of the site in the zoning petition are notified
to participate at the public hearing. The hearing follows an orderly
procedure during which the petitioner explains his proposal and then is
followed by other persons who have the opportunity to speak in support or
in opposition to the request After the public hearing process is com-
pleted, the Planning Commission votes to recommend either approval or
denial of the request. If the Planning Commission recommends approval,
then the case is forwarded to the City Council for its consideration if
the Planning Commission recommends denial, then the petitioner must file
an appeal to have the case heard by the City Council. Prior to the public
hearing before the City Council, property owners within two hundred feet
are again notified by mail and all persons have the opportunity to address
the Council concerning the case The City Council makes the final decision
on all zoning petitions
