1988-1482453L NO AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF SECTION 169(b) OF ARTICLE 6701d, VERNON'S TEXAS CIVIL STATUTES, UPON PORTIONS OF MINGO ROAD, WITHIN THE CORPORATE LIMITS OF THE CITY OF DENTON, AS SET OUT IN THIS ORDINANCE, AND PROVIDING A PENALTY OF A FINE NOT TO EXCEED $200 00 FOR THE VIOLATION OF THIS ORDINANCE AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, Section 169(b) of Article 6701d, Vernon's Texas Civil Statutes, provides that whenever the governing body of the City shall determine upon the basis of an engineering and traffic investigation that any prima facie speed therein set forth is greater or less than is reasonable or safe under the conditions found to exist at any intersection or other place or upon any part of a street or highway within the City, taking into consideration the width and condition of the pavement and other circumstances on such portion of said street or highway, as well as the usual traffic thereon, said governing body may determine and declare a reasonable and safe prima facie speed limit thereat or thereon by the passage of an ordinance, which shall be effective when appropriate signs giving notice thereof are erected at such intersection or other place or part of the street or highway, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I Upon the basis of an engineering and traffic invest gat on eretofore made as authorized by the provisions of Section 169(b) of Article 6701d, Vernon's Texas Civil Statutes, the following prima facie speed limits hereafter indicated for vehicles are hereby determined and declared to be reasonable and safe, and such speed limits are hereby fixed at the rate of speed indicated for vehicles traveling upon the named streets and highways, or parts thereof, described in Section II SECTION II No motor vehicle shall be operated along and upon M ngo Roa within the corporate limits of the City of Denton in excess of the speeds set forth as follows (a) Beginning from Frame Street and going eastward to a point 100 feet east of Ruddell Street, both directions, for a total distance of 0 568 miles, approximately, a maximum speed of 35 MILES PER HOUR (b) Thence continuing along Mingo Road to a point 50 feet east of Old North Road, both directions, for a total distance of 1 222 miles, approximately, a maximum speed of 40 MILES PER HOUR (c) Thence continuing along Mingo Road to the east side of Cooper Creek Road, both directions, for a total distance of 0 616 miles, approximately, a maximum speed of 45 MILES PER HOUR SECTION III That the City Manager of the City of Denton, Texas s ere y authorized to cause to be erected appropriate signs indicating such speed zones SECTION IV That any person violating any of the provisions of t ski oar nance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not to exceed Two Hundred Dollars ($200 00) SECTION V That this ordinance shall become effective fourteen days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of its passage PASSED AND APPROVED this the;;) day of , 1988 RAY ST PH S, MAYOR ATTEST NI WAL EtS, CITY SECRETARY APPROVED AS TO LEGAL FORM DEBRA ADAMI DRAYOVITCH, CITY ATTORNEY CITY OF DENTON, TEXAS BY PAGE TWO 20AN M T i I dd 0 WK M ° 'L7 I ~ ,A ad a t 1.
