AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR THE
APPROVAL OF A DETAILED PLAN FOR 3 9 ACRES OF THE PLANNED DEVELOP-
MENT DISTRICT (PD-119) LOCATED AT THE NORTHWEST CORNER OF U S
HIGHWAY 380 AND OLD NORTH ROAD AS CREATED BY ORDINANCE NO 86-172,
PROVIDING FOR APPROVAL OF A REVISED SCHEDULE AND ORDER OF DEVELOP-
MENT FOR THE DISTRICT, PROVIDING FOR A PENALTY IN THE MAXIMUM
AMOUNT OF TWO THOUSAND DOLLARS FOR VIOLATIONS THEREOF, AND PROVID-
ING FOR AN EFFECTIVE DATE
WHEREAS, by Ordinance No 86-172, the city Council approved a
planned development district and concept plan for 18 2 acres of
land located at the Northwest corner of U S Highway 380 and Old
North Road, as more particularly described therein, known as
Northwood Garden Professional's Office Park (PD-119), and
WHEREAS, on April 28, 1988, Insight Development applied for
approval of a detailed plan for a portion of the planned develop-
ment district, designated as Phase II of the district (formerly
designated as Phase IV in the approved concept plan), and
WHEREAS, on June 22, 1988, after a public hearing, the
Planning and Zoning Commission recommended approval of the detail
plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the detailed plan for 3 938 acres of the
planne eve opment district as created by Ordinance No 86-172,
designated herein as Phase II, as described in Exhibit "A",
attached hereto and incorporated herein by reference, is hereby
approved for the land therein described, so that hereafter the
property shall be constructed, used, and maintained in accordance
with the approved detailed plan herein approved
SECTION II That by approval of this detailed plan, there is

SECTION IV Any person who shall violate a provision of this
ordinance, or fails to comply therewith or with any of the
requirements thereof, or of a permit or certificate issued there-
under, shall be guilty of a misdemeanor punishable by a fine not
exceeding Two Thousand Dollars ($2,000 00) Each such person
shall be deemed guilty of a separate offense for each and every
day or portion thereof during which any violation of this ordi-
nance is committed, or continued, and upon conviction of any such
violations such person shall be punished within the limits above
SECTION V That this ordinance shall become effective
fourteen days from the date of its passage, and the City
Secretary is hereby directed to cause the caption of this
ordinance to be published twice in the Denton Record-Chronicle,
the official newspaper of the City of Denton, Texas, within ten
(10) days of the date of its passage

AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING ORDINANCES 86-
172, 88-003 AND 88-126 BY AMENDING THE DETAILED PLAN FOR PLANNED
DEVELOPMENT NO 119 (PD-119), LOCATED ON THE NORTHEAST CORNER OF
U S HIGHWAY 380 AND OLD NORTH ROAD, WITH RESPECT TO 0 494 ACRES OF
THE 18 24 ACRES THEREIN CONTAINED, AS SHOWN IN THE DETAIL PLAN
AMENDMENT ATTACHED AS EXHIBIT B, PROVIDING A SAVINGS CLAUSE,
PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 FOR
VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, William Cudd III, Frank Cudd, and Carl Stocker have
applied for an amendment to Planned Development No 119 (PD-119),
as defined by Ordinances No 86-172, 88-003 and 88-126, with
respect to 0 494 acres of the 18 24 acres therein defined, more
particularly described in Exhibit A, to authorize development in a
manner consistent with the detail plan amendment attached as Exhib-
it B, and
WHEREAS, on December 14, 1994, the Planning and Zoning Commis-
sion, after a public hearing, recommended approval of the requested
changes, and
WHEREAS, the City Council finds that the proposed amendments
will be in compliance with the Denton Development Plan, NOW,
THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
gECTION I That Ordinance No 86-172, as previously amended
by Ordinances 88-003 and 88-126, providing approval of a planned
development zoning district classification and use designation (PD-
119) for 18 24 acres of land, is hereby amended with respect to
0 494 acres of land located therein, and more particularly des-
cribed in the legal description attached hereto and incorporated
herein as Exhibit A, by adopting the detail plan amendment, at-
tached hereto and incorporated herein as Exhibit B for all
purposes
SECTION II That the provisions of this ordinance as they
apply to the 0 494 acres described by Exhibit A govern and control
over any conflicting provisions of Ordinance No 86-172, as amended
by Ordinances 88-003 and 88-126, but all the provisions of said
Ordinances as they apply to that remaining portion of the PD-119
zoning district classification and use designation not herein
amended shall continue in force and effect and shall apply to the
remainder of said district
SECTION III That a copy of this ordinance shall be attached
to ordinance Nos 86-172, 88-003 and 88-126, showing the amendment
herein approved
SECTION IV That any person violating any provision of this
ordinance shall, upon conviction, be fined a sum not exceeding
$2,000 00 Each day that a provision of this ordinance is violated
shall constitute a separate and distinct offense
SECTION V That this ordinance shall become effective four-
teen (14) days from the date of its passage, and the City Secretary
is hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record-Chronicle, the official news-
paper of the City of Denton, Texas, within ten (10) days of the
date of its passage
