1988-0102147L NO 'O AN ORDINANCE AMENDING SECTION 1-5 OF CHAPTER 1 OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS ESTABLISHING THE MAXIMUM FINES FOR CERTAIN VIOLATION OF THE CODE OF ORDINANCES, PROVIDING A SEVERABILITY CLAUSE, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That section 1-5 of Chapter 1 (General Provisions) of the Code of Ordinances of the City of Denton, Texas, is hereby amended to read as follows Sec 1-5 General Penalty (a) Where no specific penalty is provided for a violation of a provision of this code or any ordinance, rule, or regulation of the city, the violation is punishable by a fine (1) not to exceed $500 00, (2) not to exceed $2,000 00 if the provision violated governs fire safety, zoning, or public health and sanitation, excluding vegetation and litter violations, or (3) fixed by state law if the violation is one for which the state has fixed a fine (b) A person violating a provision of this code or other ordinance, rule or regulation of the city is guilty of a separate offense for each day or part of a day during which the violation is committed, continued, or permitted, unless otherwise provided (c) The provisions herein are cumulative of all other remedies, including, but not limited to, injunctions and other extraordinary writs This section shall govern all penalties for any violation of this Code, notwithstanding any language to the contrary contained in any other section of this Code SECTION II That the provisions of this ordinance apply only to o fenses committed on or after the effective date of this ordinance SECTION III That the Code of Ordinances of the City of Denton, as amended, shall remain in full force and effect, save and except as amended by this ordinance SECTION IV That this ordinance shall become effective fourteen (14 days from the date of its passage, and the City secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of its passage PASSED AND APPROVED this the S day of r 1988 RAY S EP 'NS, AYOR ATTEST JE ZFER ALTERS, C TY SECRETARY APPROVED AS TO LEGAL FORM DEBRA ADAMI DRAYOVITCH, CITY ATTORNEY BY
