AN ORDINANCE AMENDING CHAPTER 10 (FIRE PREVENTION) OF THE CODE OF
ORDINANCES OF THE CITY OF DENTON, BY AMENDING SECTIONS 10-2(c)(3)
AND 10'4 RELATING TO PERMIT FEES AND INSPECTIONS FOR COMPLIANCE
~ITH THE UNIFORM FIRE CODE, AS AMENDED, AND THE ESTABLISHMENT OF
FEES THEREFOR, PROVIDING FOR THE REPEAL OF CONFLICTING ORDINANCES,
AND PROVIDING FOR AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That sec 10-2(c)(3) (Amendments) of Chapter 10
of the Code of Ordinances of the City of Denton, Texas ~s hereby
amended to read as follows
Sec 10-2(c) Amendments
(3) The amendment of section 2 201(a) Inspection and
Unsafe Bulldxngs, to read as follows
(a) The fire marshal or hxs designated representative
shall ~nspect twice annually all buildings or
premises, or portions thereof, used for non-
residential group occupancies, including hotels
and lodging houses, as defined by the Uniform
Building Code, and at all other buildings and
premises as may be necessary, ~ncludlng such
other hazards or appliances as the chief may
designate, for the purpose of ascertaining and
causing to be corrected any condxt~ons which
would reasonably tend to cause a f~re or contrx-
bute to its spread, or any vxolat~on of the
purpose or provisions of th~s code, and of any
other law or standard affecting f~re safety
SECTION II That sec 10-4(a) (Fire Inspection and Permit
Fees') of Chapter 10 of the Code of Ordinances of the City of
Denton xs hereby amended so that sa~d section shall read as
follows
Section 10-4 Fire Inspections ~ Permit Fees
(a) Inspection Fees The occupant, lessee, or person
making use of any building or premxses, or portion
thereof, is required to be inspected twice annually,
in accordance with sec 2 201(a) of the Un~form Fire
Code, as amended Bach semi-annual inspection shall
be made free of charge If the fire marshal or his
designee makes a follow-up inspection to determine
whether a violation or violations observed during the
regular semi-annual Inspection has been corrected, a
fee shall be charged, and each occupant or lessee
shall pay said fee within thirty days of being billed
therefor as a condition to continue lawful occupancy
of the building or premises required to be inspected
Said fee shall be based upon the amount o£ interior
square footage of the building leased, or occupied
or used by the person The fee shall be in an amount
established, and as from time to time amended, by
ordinance of the city council, a copy of which shall
be on £11e with the city secretary Follow-up
inspection fees for common areas of such buildings
or premises shall be charged to and paid by the owner
in accordance with the square footage inspected
(b) Permit and Permit Fees Any permit required by
Article 4 of the Uniform Fire Code, as amended here-
in, or any permit required by subsection (c) hereof,
shall be issued only upon payment of a permit fee in
an amount established, and as from time to time
amended, by ordinance o£ the City Council, a copy of
which shall be kept on £11e with the City Secretary
(c) In addition to the permits required by the Uniform
Fire Code, as amended herein, any person, company or
business per£ormlng the following services shall be
required to obtain an annual permit
(1) operation of a fire extinguisher sales and
service company or business,
(ii) operation of a fire alarm sales and service
company, or
(iii) operation of a fire extinguishing system
company or business
Such permits shall be issued upon proof that the
applicant complies with all applicable requirements
of state law, as the same may be amended from time
to time
SECTION III That this ordinance shall become effective
immediately upon its passage and approval
