1987-1841995L NO AN ORDINANCE PROHIBITING THE PARKING OF VEHICLES ON BOTH SIDES OF METRO STREET FROM ITS INTERSECTION WITH INTERSTATE HIGHWAY 3SW SERVICE ROAD, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A PENALTY NOT TO EXCEED TWO HUNDRED DOLLARS, AND DECLARING AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I When signs are erected giving notice thereof, no person shall park a vehicle at any time upon the following street in the City of Denton to-wit Both sides of Metro Street from its intersection with Interstate Highway 3SE Service Road SECTION II The provisions of Section I prohibiting the parking of vehicles shall apply at all times to the street and part of streets designated therein except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the direction of a police officer or official traffic control device SECTION III Any person adjudged guilty of parking a vehicle in violation of this ordinance shall be guilty of a misdemeanor and punished by a fine not to exceed Two Hundred Dollars ($200 00) SECTION IV That if any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstance is held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares it would have enacted such remaining portions despite any such invalidity SECTION V That this ordinance shall become effective fourtebn (14} days from the date of its passage, and the City Secretary is hereby directed to cause the captxon of this ordinance to be published twice in the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, wlthxn ten (10) days of the date of its passage 1959L AN ORDINANCE AMENDING CHAPTER III OF ARTICLE I OF APPENDIX A OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY REVISING THE PROCEDURES, STANDARDS AND REQUIREMENTS FOR RECEIVING A VARIANCE OR MODIFICATION OF THE PROVISIONS OF APPENDIX A, AND PROVIDING FOR AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That Chapter III ("Variations") of Article I of Appendix A of the Code of Ordinances of the City of Denton, Texas, is amended to read as follows CHAPTER III VARIANCES AND MODIFICATIONS A General After receiving the recommendation of the Planning and Zoning Commission, the City Council may, where special or peculiar conditions would make strict compliance with any requirement of this Code unreasonable or impractical, grant a variance to or modification of the requirement if it finds that all of the following have been met 1 Granting of the request would not violate any master plans as defined by Appendix A- Subdivision Regulations of the Code, 2 The special or peculiar conditions upon which the request is based relate to the topography, shape, or other unique physical features of the property, which are not generally common to other properties 3 The special or peculiar conditions upon which the request is based did not result from or was not created by the owner's or any prior owner's action or omission B Conditions If the Council finds that a variance or modification should be granted in accordance with the provisions stated above, it may ~mpose conditions relating to the modification or variance as will, in its Judgment, substantially secure the objectives of the standards or requirements of the Code for which the modification or variance was granted PASSED AND APPROVED thls the~ day of ~~:.~ , 1987 ATTEST J~NIFER0WALTERS; CITY SECRETARY APPROVED AS TO LEGAL FORM DEBRA ADAMI DRAYOVITCH, CITY ATTORNEY
