1987-1712028L NO AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF DENTON, TEXAS, AS SAME WAS ADOPTED AS AN APPENDIX TO THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, BY ORDINANCE NO 69-1, AS AMENDED, AND AS SAID MAP APPLIES TO 18 1 ACRES OF LAND LOCATED ON THE NORTH SIDE OF EAST MCKINNEY STREET APPROXIMATELY 600 FEET WEST OF MAYHILL ROAD, AS IS MORE PARTICULARLY DESCRIBED HEREIN, TO PROVIDE FOR A CHANGE IN ZONING CLASSIFICATION FROM AGRICULTURAL "A" DISTRICT CLASSIFICATION AND USE DESIGNATION, TO PLANNED DEVELOPMENT "PD" DISTRICT CLASSIFICATION AND USE DESIGNATION, PROVIDING FOR APPROVAL OF A CONCEPT PLAN FOR SAID DISTRICT, AND PROVIDING FOR AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the zoning classification and use designation of 18 1 acres of real property described in Exhibit "A", attached hereto and incorporated herein by reference, is hereby changed from Agricultural "A" District Classification and Use designation to Planned Development "PD" District Classification and Use designation under the comprehensive zoning ordinance of the City of Denton, Texas SECTION II That the Concept Plan, attached hereto as Exhibits "B" and incorporated herein by reference, is approved and adopted as the concept plan for the district in accordance with article 11 of Appendix B-Zoning of the Code of Ordinances of the City of Denton, Texas SECTION III That the district herein approved shall be sub- ject to the following conditions, restrictions, and limitations 1 The permitted uses, which shall be determined at the time the detailed plan is submitted for approval, shall be those uses permitted or compatible with the uses permitted in a light industrial zoning district The detailed plan and permitted uses shall be approved by the City Council 2 The detailed plan shall be submitted showing that twenty (20%) percent of the street yard (the area between the right-of- way and the building), and four (4%) percent of the remainder of the property will be landscaped, provided, however, that if an ordinance is adopted prior to submission of the detailed plan that provides for or requires landscaping of the property, the provisions of such ordinance shall control over the provisions of this ordinance SECTION IV The Zoning Map of the City of Denton, Texas, adopted the 14th day of January, 1969, as an Appendix to the Code of Ordinances of the City of Denton, Texas under Ordinance No 69-1, as amended, is hereby amended to show such change in Dlstr~ct Classification and Use subject to the above conditions and specifications SECTION V That the City Council of the City of Denton, Texas, hereby finds that such change is in accordance with a comprehensive plan for the purpose of promoting the general welfare of the City of Denton, Texas, and with reasonable consideration, among other things for the character of the district and for its peculiar suitability for particular uses, and with a view to conserving the value of the buildings, protecting human lives, and encouraging the most appropriate uses of land for the maximum benefit to the City of Denton, Texas, and its citizens SECTION VI That this ordinance shall become effective fourteen {14} d'ays from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days of the date of its passage PASSED AND APPROVED this the ~day of ~, 1987 ATTEST J~NIFMR~ALTERS, CITY SECRETA ¥ APPROVED AS TO LEGAL FORM DEBRA ADAMI DRAYOVITCH, CITY ATTORNEY Description for Zoning Change Strlttmatter Tract on E McKlnney EXHIBIT "A" FIELD NOTES to all that certain tract of land situated mn the M E P and P R R Company Survey Abstract Number 927, Denton County, Texas and bemng Tract I, Tract II, Tract III and Tract V descrmbed mn the Deed from Tucker Equipment Company, Inc , to David J.
